The Corruption Prevention Agency has enumerated conflicts of interest from Pristina University's Rector Arben Hajrullahu.
Jurydical faculty professor Enver Hasani had asked the APK for an opinion concerning its behaviour and actions against the sector at the Senate meetings.
In response to the request made, The APK says there has been conflict of interest on Hajrullahu's part of his decision-making in leading the University Senate on issues dealing with Hasani.
Hasan has complained, in addition, that Hajrullahu's Rector has risen to the degree of regular professor by voting for himself and that
Hajrullahu, who has been promoted to the degree of regular professor voting for himself, has been aiming to dismiss that degree to Professor Hasan, who has cited the sector's intentions to persecute him for personal interests.
Mr. Vice President. Arben Hajrullahu, Rector of the University of Pristina, in decision-making, including preliminary moments of decision-making, in quality of the head of this university's Senate or other official decision-making quality within the university, to Mr. Enver Hasani, University of Pristina professor, would face Article 6, regarding Article 3, paragraph 1.2 and 1.12, Article 5, paragraph 8, and Article 17 and 19, paragraph 1, subparagraph 1.2, of the Law for the Prevention of Conflict of Interest”, says the opinion of the APK, which has also been sent to the UP secretary.
The APK has demanded Hajrullahu that “be reported in regard to the actions undertaken conform this opinion”.
The Agency for Prevention of Corruption says that the notion of conflict of interest, by law, is also determined: “Conflict of interest stems from a circumstance in which the official has private interest, which affects, affects, or seems to influence the conduct impartially and objective of his official task”.
In the concrete case, in meaning and implementation of the provisions as higher, and in the context of the current situation outlined above, the Agency found as at the point I of the device of this opinion that, Mr. Arben Hajrullahu, rector of the University of Pristina, in any decision-making, including preliminary moments of decision-making, in quality of the head of the Senate of this university or other official decision-making quality within the university, towards Mr. Enver Hasani, professor of the University of Pristina, would conflict with the above-mentioned provisions of the Law for Prevention of Conflict of Interest”, the APK opinion said.
As a reason, the APK cites statements and expressions used by Hajrullahu to Hasan at a meeting of the UPP Senate and have resulted in a request for them to improve and with a criminal complaint against him,
The “all these developments and the above-mentioned new circumstances (unprejudiced to create a new subjective report between the parties, as the parties in question on such issues, especially in the two processes (denoncations) mentioned above), impact the creation of a new subjective report, the basic and epilogic ratios of those processes, have and protect the personal-private interests between themselves, and that those private interests influence or appear to influence in the impartial performance and objective of formal office, in this way fulfilling the elements of the conflict, in the 5-Noise action and the official provisions of the Law, if possible interest is to the Conkrecitari, or to avoid the interest of the APTP, the reply.
The Corruption Prevention Agency, since it says Mr. “'s private interest in this case. Arben Hajrullahu cannot be excluded from his official decision-making towards Mr. Enver Hasan”, the reactor must withdraw from its participation in decision-making, including preliminary moments of decision-making, in the quality of the Senate's leader or other official decision-making quality within the university, to Mr. Enver Hasani, professor of UP, conform article 17, paragraph 1 of the Law for Prevention of Conflict of Interest”.
The APK says that in terms of actions and measures taken by Hajrullahu for “preventing and resolving the conflict of interest conform the demands of this opinion”, the Agency should be announced.
