According to official data provided by AVONET, the operator in question has submitted references issued by the municipalities Kline, Junic and Skenderaj, which contain false information about the value of the signed contracts. In a concrete case, reference issued by the Cline municipality states that services worth 550,000 have been carried out, while official data show that by the moment of the release of that reference, the contract realised was only worth 300,487.25.
AVONET estimates that these references have been used deliberately, deliberately and consciously to meet the criteria required in the procurement activity tender file “Blery of professional health services”. This action, according to AV ONET, it constitutes fraud and violates the principle of fair competition in public procurement.
In this direction, the Contractive Authority ʹ Gjilan municipality, after completing this procurement activity, dated 24.09.2024, has signed the contract worth a total of 449,683.20 euros with the economic operator “Kosova Med Health Care KPS”
AV ONET expresses deep concern over members of the applicant Commission of Offerings and Procuration Officers in the Gjilan municipality, who have failed to exercise their office professionally and full legal responsibility. According to the organisation, this has been manifested by the illegal provision of the profit of wealth for an economic operator through the execution of the procurement activity contract conducted by the Gjilan municipality.
The commission was obliged to verify the accuracy of offered documents and ensure that economic operators had not presented false information to obtain the contract. This neglect and neglect, according to the AV ONET, not only violations of rules defined in primary and secondary legislation in the area of public procurement, but also raises serious doubts about deliberate co-ordination or tolerance of public procurement fraud.
In this direction, AV ONET has been directed at the request for launch of the Basic Prosecutorial Investigations in Gjilan, under suspicion that all persons involved in this case have committed these criminal acts: Public Procure Deception (Nine 415 KPRK's false statement under oath (Nen 383 KPRK, and Misuse of Official Position or Authority (Nen 14 KPRK. AV ONET expresses full confidence in the professional work of the Constitutional Prosecutor in Gjilan and expects a thorough investigation in line with legal authorisations for the case.
Also, AV ONET reports to the public that on the 1404.2025 date has been addressed at the request for measures to be taken by the mayor of the Gnjilane municipality, Alban Hyseni, as binding on the standards of Article 56 and 99 of Law No. 04/L-042 for the Public Procuration of the Republic of Kosovo. So far, however, there is no official information about whether or not he has observed his legal obligation.
For this reason, AV ONET has once again, this time publicly appealed to the mayor of the Gjilan municipality, Alban Hyseni, to take immediate legal steps and actions necessary in terms of establishing legitimacy in this case.
