Two witnesses' statements read, defense of “Cobra City” says the principle of fair judgment is being violated

The Constitutional Court in Pristina, following special prosecutor Merita Bina-Rugova's proposal, has considered witness statements read, Alketa Sadiku and Hasime Idrizi, for which in advance the defender of the accused Dibra Hoxha, lawyer Florent Latifaj objects of violating the principle of fair judgment. Presely Judge Krasniqi said the court has submitted an invitation to the police hearing, but that witnesses have not been found at the landmark addresses.
For what prosecutor Bina-Rugova proposed that these statements be read, claiming this option is allowed with legal provisions.
This prosecutor's proposal rejected lawyer Latifaj, clarifying that witnesses should be invited to the hearing and if they are willing to make sure the prosecutor steps down from the two witnesses' statement.
Lawyer Latifaj said the Constitutional Court of the Republic of Kosovo has already built the standard for witnesses not to be read statements where the European Court of Human Rights practices are mentioned.
On the other hand, Latifaj added that the European Convention for Human Rights itself has specified that fair and reasonable judgment refers to the accused's right to request the mandatory presentation of witnesses.
Also, the defenders of other indictees claimed they back the statements of lawyer Latifaj.
The court then approved the prosecutor's proposal that witness statements be considered read and adding that the trial is interrupted to proceed with the next hearings where witnesses are expected to be heard.
The Special Prosecutor of the Republic of Kosovo (PSRK), on February 20, 2024, has filed an act against Debra Hoxhaj, known as “Cobra” and Roland Susur, Arben Veszaj, Burim Mazret and Jesmir Bandli, for the murder of Albanian citizens in Prizren a year ago.
In the indictment provided by “Justice Vow”, “Cobra”, it is charged that on January 3rd, 2023, at 4:10, near his local “Cbra City”, in the Prizren-Zhur magistrate, deliberately deprived of life of V. C, risking even the lives of those injured R.T. (S) and A.B.
Until the case, according to the prosecution's indictment it had come after the injured had not agreed to the high bill at the bar, thus starting a row with the bar workers. /Periscope/
