According to the decision of April 4, 2025, the prosecution in its application on October 21st, 2024 has claimed that these documents are authentic, important and of provative value, reports “Justice Trust“, followed. Periscope.
The defense, however, had opposed this practice of the Prosecutor, according to her, to present thousands of evidence for which their background is uncertain and have questionable credibility.
The defence argues that many of the proposed evidence have no apparent link to the charges, and the prosecution is using this method to avoid the fair verification of its evidence to bypass the procedure of verifying evidence through witnesses.
Under Defense, Z The SP has not proven the authenticity and credibility of these evidence, and that accepting them would cause prejudice.
In the ruling, the court has said the proposed evidence is made up of KLA documents and videos of time events related to KLA organisation and activities in the Nerodime Operative Zone between 1998 and 1999.
Under the ruling, the prosecution has said these evidence testifies to the high level of KLA organisation, including the area in question during the period of the indictment.
The SPS has claimed KLA members in this area acted under the authority and orders of the accused and the General Staff.
In addition, the SPS says that through these documents they aim to prove that some of the accused and some KLA members in this area had the common criminal goal which they personally implemented and through existing structures.
The evidence of 35 and 37 had opposed the defence, while the panel through this decision has said it is alongside the SPS argument that these documents are important to show the KLA's alleged practice of identifying and monitoring persons suspected of co-operation with Serbs.
The SPS on these documents says they reinforce and complete other evidence and previously judged facts related to crimes in the indictment, as well as the existence of a systematic and widespread attack on the civilian population.
“The SPS states that the proposed evidence also reinforces and meets other evidence and previously tried facts, including about (i) the alleged crimes; (ii) the existence and elements of an international armed conflict and the alleged existence of a widespread and/or systematic attack on the civilian population; (ii) effective control claimed by the accused, directly and through ZON structures; (iv) practical assistance, encouragement and/or moral support provided by the perpetrators accused of crimes; and (v) knowledge and other members of the NP and other members accused of”, said in decision.
As for authenticity, the panel has said in the decision that most of the proposed evidence is handwritten documents and making signatures that seem to be KLA members, including commanders such as Ferriú, {Metí, yetresorı, APUYYYYYYYYYYYYYYYYYYYYAhmet Kaciku, yet. Selimi, '%Graniti', 'Dulla, 'Agimi', Rajadan Rexhepi' and 'Topi.
According to the decision, most of the documents also hold logo or reference numbers of the Nerodima Zone. Five of these tests, according to the ruling, are public videos featuring KLA members during the period of the indictment.
These documents, the panel has seen them as acceptable that then a general assessment of them can be made at the end of the trial.
For testimony seven and some of the pages (1, 2, 4 to 11) of testimony 47, according to the decision, there are sufficient elements of authenticity and the panel has therefore rejected them.
As a result, material evidence was accepted between 1 and 6, 8 and 46, and 48 to 97. Similarly, page 3 of the testimony 47 was accepted in material testing. However, it was denied on pages 1-2 and 4-11 of the 47 testimony and testimony 7.
