Tahiri: I'm going to engage to restore full guarantees for civilian service

This development violates the acquired rights and legitimate expectations of civil servants, and conflicts with IGMA standards for a stable, professional administration protected by political influence. Also, it conflicts with the European Union's repeated comments, requiring Kosovo depoliticisation of administration and respect for public servants' judicial security. In this context, it conflicts with the very obligations Kosovo has made with the SAA for reforming the state administration in close co-ordination with the EU” writes Tahiri.

Tahiri said all interference in the law are creating practices that could seriously jeopardise the institutional functioning of the state.

He promised to commit to restoring full guarantees for civilian service.

Law guarantees for civil service an ongoing battle
The Constitutional Court's announcement in cases of Ko222/24 and Ko224/24, which assesss the transitional provisions of the Law for Public Officials (Law No. 08/L-294), which turns the middle and low-level management positions from the indefinite position to limited mandates, is a dangerous turning point for the future of civil service in Kosovo and violating their judicial guarantees.
This development violates the acquired rights and legitimate expectations of civil servants, and conflicts with IGMA standards for a stable, professional administration protected by political influence. Also, it conflicts with the European Union's repeated comments, requiring Kosovo depoliticisation of administration and respect for public servants' judicial security. In this context, it conflicts with the very obligations Kosovo has made with the SAA for reforming the state administration in close co-ordination with the EU.
All interventions in this law are not inspired by the principle of proper and sustainable regulation of state structures. In fact, they are creating practices that can seriously endanger the institutional functioning of the state. These changes are affecting the stability of public administration and can undermine citizens' trust in institutions that should be stable and depoliticised.
This decision is part of a broader trend for institutional control, just as in the case of continued efforts to influence the Independent Council for Civil Service, through the dismissals of members, interference in its mandate, and violation of the role overseer that it must play in defence of the independence and impartiality of the civil service.
In my former role as National Co-ordinator for State Reform, Deputy Prime Minister and MP have always had a single and clear focus: preserving and strengthening legal guarantees for an independent, professional and depoliticised administration. This has been my main commitment to an administration that respects international standards and acts in the interest of citizens, not in the interest of political groups. I strongly believe that a strong and independent civil service is the foundation for a stable state based on the principles of rule of law and transparency.
Even though I, I have rejected this change in some cases, we know that after several attempts to control civil service, this decision has been accepted. However, I will engage to restore full guarantees for civilian service. I will work to ensure and preserve our independent, modern, professional and depoliticised administration.
This is my commitment, therefore, to a powerful and independent administration with no external influence, and to the protection of these guarantees necessary for Kosovo's stability and development.
