Smaqi after he pronounced the fine on Kurt: Legal conditions have been met to appoint 30-day detention measure

The Constitutional Court in Pristina has pronounced 250 euros in fines to incumbent Prime Minister Albin Kurtin for his failure to appear in Special Prosecutor (PSRK) to testify concerning the case of state reserves. It's been almost four months since Special Prosecution has sent an invitation to incumbent Prime Minister Albin Kurti to present himself as a witness for the state reserve case. Four invitations for four months, but Kurt has not yet filed for an interview. And as the law wants, for these actions Prime Minister Kurti would have to be punished, writes Periscope.
For Periscope, Kosovo lawyer Xhevdet Smakqi has said that with this fine, the legal conditions of Article 132 of KKPK have been met for the appointment of a 30-day detention measure in the case of witness Albin Kurti.
Smakqi has indicated that never in the courts of Kosovo has there been a case in which a witness has refused to go to the prosecutor for any particular case.
We consider that it is the first time 132 of the Republic of Kosovo's Criminal Procedure Code is challenged by its implementation throughout the paragraphs, because until today in the Judiciary practice there has not been a witness to be rejected even when it is found in Kosovo, the address is known in all cases the court has brought them under obligation to testify. The rejection witness case behind the prime minister's chair and citizens' votes is challenging P as well. The SRK and the Court, but also Article 132 of the KKPPRK”, he has said.

The lawyer has added that legal conditions for the appointment of a 30-day detention measure for the incumbent prime minister have been met.
Therefore, since the Court has already fined the rejecter witness, Albin Kurti must see that the witness paid the fine of 250 euros in the terms of the fine order, if not then the Judge of Pre-Procedure Procedure should create the conviction that this witness should not be fined again after a physical presentation order in the PRSK has refused to add here even public statements to the refusal. Enough conviction is created that provisions from Article 123 have been met KPRK's move to witness Albin Kurti's 30-day detention measure” has been voiced.
Smakqi has asked the law enforcement agencies not to surrender to Kurt.
“Differently, the pillar of justice falls and the Republic of Kosovo must be handed over to witness Albin Kurti to exercise the competencies of the prosecutor, judge, merely communist North Korean-style dictatorship”, he said further. /Periscopi/
