KOHA Media has reported that incumbent Prime Minister Albin Kurti has complained at the Pristina Constitutional Court about the 250-euro fine this court imposed at the beginning of the month after failing to appear in the Special Prosecutor to testify about the state reserve case, broadcasts Periscope.
According to the Criminal Procedure Code, the court's chief is obliged to appoint a college of three judges to handle this complaint. The court has not shown how far the complaint has gone.
Kurti was fined 250 euros after demanding that the prosecution go to the prime minister's office. He was invited to testify about allegations in the case of state reserves. The prosecution suspects the state has been damaged by about 600,000 euros during the procurement for supply of products for state reserves.
Article 132 paragraph 1 of the Criminal Procedure Code envisions that the judge of the preliminary procedure under official duty or the state prosecutor's request may force the witness to appear to give a witness.
And if the witness doesn't show up, this code sees that the judge condemns the witness with a fine of up to 250 euros for any denial.
And if the witness does not testify even after being fined, then he may be imprisoned for a month of imprisonment when he begins witnessing.
Prime Minister Kurti has repeatedly demanded that prosecutors go to the office and said he has the precedent for that, but the court has ordered him to testify to the prosecution.
