PDK seeks investigation into Alban Hyseni: Bad use of 500 thousand euros tender

In the PDK's statement, the denounciation reportedly concerns a tender, which, according to this party, the first abused Gjilan.

It adds that the tender has been worth 500,000 euros for employing 46 people in the QKMF.

Public prejudice against Alban Hyseni, who misused the 500 thousand-euro tender for employing 46 people in the QKMF, seriously violating the procurement law and contract with the economic operator “COMM SOVAMED”

We call on the Constitutional Prosecutor in Gjilan to initiate the investigative procedure against the mayor of A.H. Regarding serious legal violations of procurement and public finances, through misuse of tenders, illegal contracts, family employment and multiple financial abuses.

One of the random cases involved this tender. The municipality of Gjilan has announced tender for employing doctors and nurses at the QKMF and mayor of the municipality on September 24th 2024 signed the contract with economic operator “COMM SOVAMED” from Pristina, worth 449,683.20 euros. This project has not been planned in the municipality budget for 2024, nor in the annual procurement plan in Gjilan.

Under this tender contract (Anex 1) the municipality of Gjilan has called for the employment of 28 health professionals. Doctors 20, nurses 3 and dentistry 5 employees.

Article 1.3 of this contract says that; The compensation allowed by the total indicator value is +/-30%. If the purchase order exceeds the total indicative amount or total indicative value of the framework public contract (including + 30 percent 30%), regardless of the original expiration date of the Cornise Public Account, the contract will be automatically interrupted. The allowed non-compliance plus/minute thirty percent is also valid for position/article, and in the event of achieving the allowed AK threshold, there is no other order for that position/article.

But the mayor has violated the procurement law and contract with “K O SOVAMED”, asking this company to hire 46 people, thus exceeding nearly double the contract.

According to the tender, three nurses have been asked to hire, but currently are employed with tenders over 19 nurses, so it has exceeded 63.3% of employees under this contract. The price of 450 thousand euros has also been planned to be spent for three years, and this unplanned budget is still being spent a calendar year.

In addition to legal violations and overstepping the contract, other officials, such as the co-ordination lawyers, have been no part of the contract with the economic operator. All of this has happened to employ family members of VV senior officials and senior QKMF management. Many employment through this tender has been made to buy their silence, for violations that were made earlier in regular competitions announced by the QKMF in Gjilan.

Currently in the municipality of Gjilan are illegally employed, without competitions of over 130 persons between contracts in the work and through this scandalous tender. With these abuses, Alban Hyseni is spending within the year close to a million euros in budget unplanned by the category of goods and services. For these financial abuses, the mayor of the municipality must be accountable to the law, and that happens when the sleepy prosecution of Gjilan takes action.

The PDK will take further steps if even after this case continues its final silence in Gjilan.
