Although the indictment has been filed against the acting minister of Regional Development, Frustim Damka, for criminal acts “Candor” and “Attack”, he continues to hold his post in the Government of Kosovo.
Despite the fact that he and his son attacked two people, Kosovo Prime Minister Albin Kurti does not see the dismissal from Minister Damka's post on the road.
Violence is a girl and the Constitutional Court's decision in Prizren, for the extent of domestic arrest by Minister Damka, is not even impressed by President Vjossa Osmani. That was after the incumbent minister, yesterday he accompanied President Osmani during his visit to Turkey.
The Law on the Government of Kosovo states that the mandate of the member of the government, among other things, concludes whether it is sentenced to court rulings of a firm form for criminal offence to one or more years in prison, and whether, with judicial decision of the cut form, it has been pronounced a supplementary punishment for preventing the exercise of office in public service and whether it is dismissed by the prime minister.
The latter, there is legal basis for dismissal under the Law for Public Officials, however, allegedly the dismissal is not happening because Kurti needs community votes for forming the new government.
The Law on Public Officials states that the use of physical violence or the threat of persons is strictly prohibited in any circumstance and is regarded as a serious violation of professional ethics and the integrity of public duty.
Under the Law for Public Officials, the official may face measures as temporary suspension from work, transfer to another position, landing and leaving office.
The Constitutional Prosecutor in Prizren on 25 March this year has filed charges against incumbent Regional Development Minister Fikrim Damka and indictees F.D., who are charged for “Attack”
According to the prosecution, Damka was charged with using physical force against the injured A.M., and M.J., on election day because of an earlier dispute with the latter.
In this case, the lawyer of the damaged party A. M Gent Djind requires incumbent Albin Kurti to fire Minister Fikrim Damka from his post or suspend him until making a decision on the cut form.
Djind in a proposal for Kosova Prees, says that with the introduction of new laws into force and changing the penal code, official persons who have an act filed, do not have the right to exercise their office and attend government meetings. /Persycope
