Today's hearing against accused Gravalo Milosavlevki has been postponed, as witness Binak Buyipaj, proposed by his defence, lawyer Dejan Vasic, was not present at Friday's session.

This was made known by the chairman of the court, Vesel Ismaili”.

“Binak Buyipaj has been invited to yesterday's session, but the same has not appeared, and why the court does not possess evidence that the same man has accepted the invitation. But in the conversation yesterday with the lawyer, he said he'd try to secure it, but he's obviously not present in the hall”, Judge Ishmael said.

In this case, Milosavlevqi, in the quality of the guard in the Dubrava prison, is being accused of war crimes against the civilian population.

Regarding this witness, attorney Vasic proposed to the court that today's hearing be postponed, asking for a timeline to ensure his presence, and if he doesn't succeed, then they will give up his hearing.

I've been trying to contact this witness for today's review, but I haven't succeeded, and I'm asking you to put off today's review, and I will address the court in a very short term if it's possible to contact this witness by phone. If I'm not successful, we'll give up listening to this witness and we'll soon announce to court”, Vasic said.

Also, Vasic proposed the hearing of another witness, Aslan Visoqi, who he said would provide the phone number as well as his address.

According to the lawyer, the Visoqi family had been at odds with Milosavlevki's family, and prior to the war, Aslan Visoqi's father had fired eight bullets in his client's father, for which he was convicted.

In this regard, the defender stated that these evidence has been handed over to the prosecution, but that the same have not been handed over to the tribunal, reports Justice Vow, report Perixopi.

As for the proposal for witnesses, prosecutor Ilir Morina did not object to their hearing.

While, in regard to evidence the defence has handed over to the prosecutor, which relates to the detention of Visoqi's father, prosecutor Morina said this evidence has nothing to do with the object of the prosecution.

And as far as the documents are concerned, we have them on the subject paper and I believe we delivered them to the court. The fact that we don't have the list in the indictment doesn't mean they're not part of the subject paperwork. We do not consider any evidence concerning the object of the indictment of war crimes against the civilian population,” Morina added.

In terms of these proposals, the court took the ruling with which it approved proposals for the hearing of Buyipaj and Visoqi witnesses, and decided that the evidence handed down will be administered.

As there were no conditions to continue with the session, the same was interrupted and will continue on another date.

According to the indictment filed on November 29, 2023, it is said that Gavrilo Milosavlevq in quality of the official in the Dubrava Prison in co-ordination with others had applied depressing murder measures, beating, torture, cruel and inhuman treatment of Albanian civilian prisoners.

Always according to the indictment in co-ordination with Serbian police units Milosavlevik had carried out the mass murder of Albanian prisoners on the day of the incident, had ordered that 1,000 prisoners in the prison courtyard of the country named “Sports Fuja” appear, on the pretext that they would count prisoners and send them to a safer location to protect prisoners from NATO bombings.

The charge is said to have immediately followed the formation of Serb military prisoners had fired prisoners with machine guns, mortars and other weapons, and that this assassination operation, which had begun from May 22nd 1999 and lasted until May 24, 1999, resulting in the attacks killed 109 prisoners.

In the indictment it is said that defendant Milosavlevovic in co-ordination with other Serbian military officials had gone almost every day through Dubrava's prison wards, namely, at the “B” and “C”, beating the Albanian civilian prisoners in a cruel and inhuman manner.

In the indictment, it mentions how some guards had even gone to the cell where Ukshin Hoti, Gani Baliu, Skender Gashi, Mehmet Memqaj, and Shkelim Zlatoga, where the same were first turned off lights and then directed to the Ukshiin “Professor of your fight is happening to us the shellings of NATO”, insulting and insulting him all the time, that at one point, guards were reportedly caught at the bottom of Shkarkam Zlatoga, where they had almost stopped breathing.

The accused Milosavlevic is accused of committing the criminal act “war against civilian population”, sanctioned by Article 142 concerning Article 22 of the Criminal Law of the former Socialist Federation Republic of Yugoslavia (now”) RSFJ's LP “) as the law in force at the time of the criminal offence. /Perixopi/
