A Spanish woman who had sought disability pension for speech after an incident related to work 16 years ago was exposed as a fraud by a private detective.

In 2003, a woman who worked in a supermarket in Andaluz, Spain, was attacked by a customer.

After the traumatic incident, she was diagnosed with post-traumatic stress disorder and the loss of her ability to speak.

After reviewing her case, Social Security granted the woman a permanent disability pension, but because it was a job-related incident, the security company was considered responsible for the costs.

Years later, according to regular procedure, the insurance company reviewed its case and found some irregularities that sparked further investigations.

A few years ago, she hired a private detective who discovered that the woman spoke normally but continued to register her payments for limited ability.

In 2019, sixteen years after the incident that had caused women's speech damage, the insurance company responsible for paying for their limited capacity benefits began to review her medical records and noticed that none of the experts she had visited since 2009 (ofalmologist, orthopedic and dermatologist) had recorded her reports of the inability to speak.

This was considered unusual, so they asked a team of doctors to reevaluate the woman's condition, and at least one psychiatrist reported possible signs of fraud.

A medical expert's suspicion was not enough to open a case against his wife, so the insurance company hired a private detective to follow the woman around and collect more evidence.

After a few weeks, the private eye reported that the mute woman speaks normally on the street, talks to other mothers outside the school door, uses her mobile phone without a problem, and follows the teachings of Zumba”.

To prove without a doubt that the woman could speak, the private detective approached her on the street one day and asked her for instructions on how to get to a local store.

She fell into his trap, explaining perfectly artificed Spanish eloquently how to get to the store without knowing that she was being registered.

With this final test, the security company took legal action to prove that it was no longer responsible for providing the benefits of limited capacity.

In January, the Supreme Court of Justice of Andalusia (TSJA) ruled in favour of the insurance company, arguing that the evidence presented in court was valid and that it no longer needed to pay the benefits of the woman's inability.

She also dismissed the woman's complaint that the detective's registration be rejected by the court because it constituted a “clear violation of her constitutional rights”.

“A simulation of pseudamism has been created, or at least a very favourable progression or evolution of such symptoms, as the restrained symptoms have disappeared”, the Court's decision reported on the Spanish media. La Republica.

After the January decision, a new issue has been opened to the woman to determine the fine she will have to pay for the illegal collection of benefits for an existing state.

The insurance company will also most likely sue the woman to recover the benefits paid for 16 years./Periscopi/
