As for the issue if it fails to reach the winning election party to secure the majority, Baraliu says the Constitutional Court's decision is clear that the party reaching 61 votes forms the government and does not matter whether it is the second or third party.

The Convention Constituent hearing, called by President Vjosa Osmani within legal terms, will be held on Tuesday, April 15th, starting at 10:00.

Only after the constitutional session has ended can the first state continue with its legal obligations to mandate the first party to form the new government. However, it is in its discretion to later mandate other parties to form the government, if the Vetevendosje Movement as the winning party does not receive the support of 61 deputies in the Assembly for the new government.
The constitutional hearing differs from the usual parliamentary hearings, and there are no talks and parliamentary debates. It will be led by the oldest MP, Avni Dehari from LVV (78-year-old) and the youngest MP, Sala Jashari from PDK (25).
The Constitutional Court has interpreted that the right to propose the prime minister belongs to the first party, but has not determined whether this right remains valid if the first party does not present its candidate.
Kosovo Assembly Chairman-in-Office Glauk Konjufca, at the meeting with representatives of parliamentary political subjects released from the February 9th elections, have agreed that the subject with the largest number of MPs, the Vetevendosje Movement, respectively, will be lowered to the middle seats of the plenary hall. On the right side of the hall, from the perspective of the chairman of the session, the second consecutive subject of the Democratic Party of Kosovo will be lowered, while the Democratic League of Kosovo on the left.
