The Constitutional Court of the Republic of Kosovo has declared paragraphs 4, 5 and 6 of Article 331 of the Customs and Actis Code invalid, arguing that they violate constitutional principles of equality before the law, values and protection of property.
According to the Court, these provisions create judicial uncertainty and violate the acquired rights of Customs officials, especially for those who have not had preliminary positions in this institution.
Meanwhile, paragraphs 2 and 7 were assessed as consistent with the Constitution. The request for temporary measures was refused. The verdict was unanimously made by the court. /Periscope/
