“Trump could dismiss US prosecutors and judges”, former EULEX judge writes about the Special Court

In this writing published in the Balkans Insight, former EULEX Judge Pineles has done an analysis of reports Thaci has had with Trump, of the trial being held in The Hague, as well as of the time Thaci was brought up.

In this writing, he also cites Hashim Thaci's report with Richard Green and his statements on Thaci's release.

But, the most important part of the former judge's writing, is related to measures America can take regarding the Special Court.

In one part of the article, Pineles writes that America may require the withdrawal of all American staff into The Hague Specialised Chambers. That may include the chief special prosecutor as well as some American judges.

Also, while the US, as I know it, does not offer any direct financing to the Special Court, as this is done by the EU, Trump could still be involved in these internal operations by dismissing all Americans sent to the Court by the State Department. That could include the tribunal's chief prosecutor, one of the prosecutors in Thaci's case, as well as the chairman of the court in that case”, says the report, broadcast Nacional.

Pineles also mentions the possibility of abolishing the Special Court but, according to him, suspending Thaci's case.

“Yeah, it would, but cleaning up the mess would be somebody else's problem. Less than eliminating the court, the Assembly could change Article 51 of the Statut to offer the authority for forgiveness, which now specifically is disfellowshipped, and offer greater authority to ease sentences from another state, say the US, where Thaci could be transferred to serve his sentence, if sentenced to”, writes former EULEX judge.

Thus, the Kosovo Assembly could be pressured to abolish the constitutional amendment and the special statute with which the court was founded as the quid pro quo (in exchange) of aid restoration and maintaining military presence. This would constitute the necessary <x1-> legal actions” supported by Greenelli”, he writes further.

Pineles points out that Trump has proved that he did not sleep hard with the intervention in justice, including the pardon of the convicts for protests in The Capitol.

“Trumpi has testified in his first month in power that he is hardly opposed to taking bold and inconsistent action when they adjust to his goal, even eliminating entire federal agencies and firing thousands of federal workers. At this point, Trump has clearly testified to his willingness, if not thirst, to exploit his authority for forgiveness and to ease the penalties for those for whom he believes they have been treated unjustly. For example, he forgave about 1,500 people who were convicted of violations in connection with the January 6th 2021 uprising at the U.S. Capitol, creating rage”, writes the former judge in Kosovo.

The judicial process in the case of KLA leaders is at the end, with witnesses from the prosecution closing in April.
