Special Court establishes new conditions for Hajredin Kuchin: Do not communicate with any of the accused

Kosovo Specialised Chambers ( The DPS) in The Hague have set new conditions in addition to showing when there is a need for Hajredin Kuci, who is accused of disobeying the tribunal in a case together with Hashim Thaci, Fadil Fazliu, Smakajn Union and Isni Kilj.

The SPS had demanded that Kuci be added as condition that he not communicate with any of the accused and others mentioned in the indictment as Fahri Fazliu, Blerim Shala, Artan Behram and Vlasnim Kryeziu. The motion was approved on December 19th 2024 by the judge of the preliminary procedure, Marjorie Masselot, which was made public on March 17th 2025. Disrespecting the conditions imposed on Kuci, according to the decision follows the order to arrest and stop him, broadcasts Periscope.

According to the SPS, this condition on Kuci is needed to protect the procedures. The SPS argues that the only practical and effective move to avoid any risks of procedures is to prevent Kuci from having contact with the banned persons and those mentioned in the indictment.

In the prosecution's request, the defense already charged Kuci has not been answered.

Otherwise, in the court's appeal to Kuci, the accused has already been ordered not to discuss with any person exclusively his lawyer about the procedures that have been initiated against him, nor on the charges. In addition, Kuchi's decision is prohibited from direct or indirect communication with any potential witnesses or victims.

And now the ZPS has requested a special ban on any contact through any way with prohibited persons concerning this case.

As a result, the judge of the preliminary procedure has considered that the SPS's request is only to add a condition to the conditions already set in the decision on calling to Kuci.

By stopping at Kuci's co-accuses, the judge has mentioned the fact that, according to the indictment, they are all accused of disobeying the tribunal.

As a result, Masselot in her decision says she is convinced that stopping any contact between Kuci and those mentioned in the indictment is necessary for preparing and developing procedures and protecting its integrity.

“also, as it concerns REDAKU], the Pre-Plain Judge considers that, even though they are not charged and/or not appointed to the Confirmed Act, they: (i) visited Mr. Thaci me [ REDAKU], where they discussed the testimony of the witnesses of the Specialised Chambers; and (i) were the subject of discussions between Mr. Thaci and Mr. Bitch. As a result, the Preemptive Judge is convinced that the ban on any direct or indirect contact between Mr. Kuci and [ REDAKUED] is necessary”, the decision says.

At this stage, until another order, the decision is binding on Kuci to refrain from any communication with Thaci, Smajan, Fadil and Fahri Fazliu, Shala, Behramin, Kryeziu, Ciline, and a person whose name is edited.

While, as a punishment measure in the event of disrespecting this decision, it would be the issue of an arrest warrant for Kuci, as well as its ban.

And Hajredin Kuci has been handed over to the confirmed indictment and the call to appear before the court of preliminary procedure for the initial presentation, which was held on. December 9.

According to the indictment, Thaci individually and through joint actions with groups; The band Fazliu (Fadil Fazliu and Fahri Fazliu), the Smaj Group (Bashkim Smaj, Blerim Shala and Artan Behrami) and the Kilaj Group (Isni Kilaj and Vlasnim Mayoriu) have followed a pattern of conduct to prevent official persons from performing official duties.

The indictment says Thaci has led and participated in these efforts through his visits to detention facilities during the time he was detained under his trial for war crimes and crimes against humanity.

It says that members of the Fazliu Group, the Smaj Group and the Kilaj Group were co-ordinated to influence SPS witnesses during the unprincipled visits of July 2nd, September 9th and October 6th 2023.

As a result, three counts of obstructing the official person in carrying out official duties bear against Thaci three counts of violations of the procedure's secrecy and four counts of disobedience to the court.

While, Kilaj, Smaj and Fazliu are accused of trying to prevent official persons from performing official duties and disobeying the tribunal. However, Kuci has two counts of contempt of court.
