Journalist Kreshnik Gashi has estimated that Kosovo Prime Minister Albin Kurti's refusal to appear at the Special Prosecutor, according to the Constitutional Court's decision in Pristina, poses a danger to the rule of law and the country's legal system.
According to Gashi, the court's decision to impose Kurti's testimony to the Prosecutor's Office has legally changed the situation, making this issue more serious.
There are some elements that need to be found today and also connect them to proper names in this situation. On the day the warrant was issued for the prime minister's interview, when there is a debate about whether the prime minister should go to the prosecutor's office or be in his office. I've been a follower of her that the prosecution should go wherever the witness is because I have to adapt to the needs of the witness. However, the situation has changed after the court ruling, the case has become serious when legal control is under way. And the moment the prosecution convinced the court that the interview should happen in the prosecutor's office and not in the prime minister's office, the situation has legally changed. And we have a decision or order from the judges that the prime minister moved with his office to the prosecutor's office”, Gashi said at Debat Plus.
Gashi has stated that the same judge who has issued the order for Kurti, Valon Kurtaj, has also signed the international warrant for the extradition of Milan Radojici.
The moment we have our prime minister's distrust of the orders of Judge Kurtaj. What happens to us, when somewhere in Europe a member of Radojciki is arrested and he is put in the context should be extradited to Kosovo or Serbia. I think that the damage done to Milan Radojciqi's process in disrespecting Judge Kurtaj from our prime minister, Albin Kurti, is huge and I think he's mistaken right now. The prime minister had to go for the court's credibility, for the sake of the judge, who was entrusted with the entire Radojciki report to the prosecutor.
Why did someone trust Valon Kurtaj in the Interpol International Arrests, when his prime minister did not believe him, for a simple act of”, Gashi added.
Prime Minister Kurti, meanwhile, has stated he is willing to testify in the case of state reserves, but has insisted that the interview be conducted in his office in the prime minister. He has said he has not refused Prosecution invitations, but seeks to avoid interpretations that could present him as involved in a corruption case.
In a response, the Kosovo Prosecutor's Council and the State Prosecutor's Office have stressed that respect for the law is the obligation for all and that Kurt's statements are undermining the functioning of democratic institutions. /Dukagini
