The American Economic Oda in Kosovo, in a response, has estimated that rule of law is the cornerstone of democratic governance, economic stability and investor confidence.
This OEA response came after recent developments, where Prime Minister Albin Kurti ignored yesterday the court's order to submit to the Prosecutor for an interview with the state reserve scandal.
A strong and independent judicial system, free from political interference, is vital to ensuring institutional integrity and public confidence. Consistent and impartial implementation of legal norms not only protects democracy but also promotes a predictable business environment needed for sustainable economic growth.
Respecting the legal framework is not only a constitutional obligation but a fundamental precondition for good governance and economic development. The Code of Criminal Procedure of the Republic of Kosovo in an experimental manner envisions that investigations and prosecutions should be conducted legally and fairly before competent judicial bodies. The law stipulates the task of institutions and public officials to co-operate in full proceedings. Any obstruction of justice, including intervention in investigations or disrespecting legal obligations, constitutes serious violations of the law, as well as weakening the integrity of Kosovo institutions.
Also, every individual's refusal despite his position to follow the court's orders and to meet legal procedures undermines the public's confidence in government, as well as erode Kosovo's democratic base. Penal Code confirms the legal consequences of obstructing justice and misusing official authority. Any action that hinders or violates judicial processes should be unequivocally condemned, since it threatens the principles of accountability and transparency.
A steadfast commitment to rule of law is also extremely important for attracting foreign investment.
International investors seek legal security, institutional stability and fair implementation of contracts. The perception of political influence on judicial procedures or ignoring legal procedures could hinder investments and limit Kosovo's economic potential. To promote a competitive and welcoming climate for investors, institutions must guarantee legal security and demonstrate a clear commitment to fight corruption and ensure transparency.
In liaison with the Special Prosecutor's investigations about possible abuse of authority in the case of state reserves, the American Oda calls on all political and institutional leaders to fully respect the legal process and co-operate with judicial authorities. The fight against corruption and abuse of office is a common responsibility that requires the firm commitment of all government branches, but also private sector and civil society”.
