Lawyer Arianan Koci has disagreed with the judge's decision on the preliminary case to arrest the head inspector of work, Iron Nikci.
Koci has named today's decision on Nikci a dangerous precedent, while listing a host of procedural violations in his client's case.
The lawyer has announced that, within the previous legal deadline, he will file complaints against this decision.
This decision does not address the whole injustice of the procedure to him, as he is being pursued on an administrative issue, where the finance ministry and the Independent Council for Civil Service are the parties. The investigation began just 20 days ago, but the pressing and unreasonable manner of his detention has brought a series of serious concessions on the prosecution's part. On the day of the ban, the Chief Inspector has been under police supervision, has not been allowed to participate in an official meeting previously scheduled and has been barred from using the telephone. According to his statements, freedom of movement has been restricted since 0900, while in official documentation it figures it has been banned at 10:30.
It remains unclear what decision has been justified in restricting his freedom for an hour and 30 minutes? Also, in the detention requirement, the prosecution itself has claimed that the damaged party has not been allowed complaints, because the administrative decision did not pre-emptive the legal means. Such a concession is responsible for the judicial sector of the relevant institution, not the Chief Inspector. Moreover, the damaged side has already been exercising the complaint, which makes the prosecution's claim to procedural damage completely groundless. In the judicial practice in Kosovo, there have been many cases of similar concessions and such extreme treatment has never been applied. This raises a serious question: why has the prosecution acted so hastily and with such a harsh approach in a case that clearly has administrative character? For other procedural concessions that have occurred in this case, I will file complaints in the previous legal term. This is not just an individual case. It's a dangerous precedent that violates procedural rights and judicial security. Such an approach should not be tolerated!”, Koci's statement said.
The Constitutional Court in Pristina has decided on the move to arrest Nikci, even though the prosecution had sought jail arrest.
Nikci is suspected of misusing official duty. He was detained Thursday by Kosovo Police.
