Former President Hashim Thaci's adviser, Artan Behrami, has stressed the urgent need to restore justice to the Special Court, criticising the delays of Kosovo institutions in addressing the injustices of this international mechanism.
He has expressed concern that Kosovo has given everything for the establishment and operation of the Special Court, including laws, competencies and full trust in international justice.
However, according to him, this court has misused Kosovo's trust and caused major injustices against KLA leaders.
Behram has stressed that due to lack of concrete action by the Government, Presidency and Parliament, injustices have continued for four years.
Unfortunately, the institutions are too late to return justice, which the Special Court has taken away from us. Kosovo has given everything to the Special Court: we have given it to the law, we have given it the competencies, the Constitutional Court, so we have entrusted it to the state of Kosovo. The Special Court has grossly misused this Kosovo readiness -- this belief that Kosovo has had in international, European justice. We are late, since Kosovo institutions, the Government, the Presidency, the Assembly have not taken a step to address the concerns which have been raised now in four years”, says Behrami.
He has cited criticism from the White House and has suggested that after the formation of the Assembly and Government, Kosovo should take immediate steps to restore legitimacy and justice in The Hague.
That, according to him, can be accomplished through the establishment of an investigative commission in the Assembly, which will examine the Special Court's injustices and prepare a report to send it to the states that finance this court.
There is also criticism from the White House, where Mr. Green criticised the institutions of the Republic of Kosovo that, because of political reasons, have taken no legal step to restore justice to The Hague tribunal. What we should do urgently, once the Parliament and Government are formed, is to take some steps to restore once again legitimacy to The Hague, because Kosovo's history is being judged there. We have to act, first in the Assembly, we need to create a Commission that investigates all these injustices that have occurred at the Special Court and this report to be sent and communicated with the states that finance the Special Court”, Behram says. In this context, he has stressed the importance of a Resolution in the Kosovo Assembly, which will serve to seek support from friendly states and to inform international partners of changing attitudes towards the Special.
He has also stressed the need for close co-ordination with the US, who have already changed their stance on the issue.
According to the former adviser, restoring legitimacy to the Special Court is a necessary step to ensure a fair and transparency process for all involved in this court.
We must make a resolution in the Kosovo Assembly, which should be distributed to friendly states. We need to start a communication with the states that finance the Special Court and coordinate with the U.S., because their position for the Special has already changed, and we have to act with them in order to find mechanisms for how to restore special court legitimacy. This is not about abolition, Hashim Thaci and others deserve a verdict on innocence”, he added. / Periscope/
