What about the two special decisions Thaci received his visit to the sick father?

On January 28th 2025, Hashim Thaci had submitted two requests for provisional release to Kosovo to realise a three-day visit to his father, who recently had health problems. These two requests, which have even been rejected, were sent by Thaci through his defense to the court where he is tried [...]
These two requests, which have been rejected, Thaci through his defense had sent to the court where he is tried for war crimes and to the judge of the preliminary procedure accused of obstructing justice administration.
Thaci had asked that he visit his father in the presence of his mother, the guardian of his father, wife and son, reports “Justice Trust”.
According to the January 31st 2025 decision, Thaci's defence had presented that the state of health of his client's father constitutes urgent and extraordinary circumstances justifying Thaci's release for humanitarian reasons.
According to Chief Judge Charles Smith's decision I II, the SPS had rejected the request, arguing that provisional release should not be accepted for Thaci, since it has been found to have provided unauthorized visitors with confidential information regarding the content of evidence for future witnesses.
While the administration had noted that Haxhi Thaci's poor health situation (Tadic's father) is a situation that has continued since Thaci's recent visit to Kosovo on September 1st 2023.
The administration stresses that alternative tools exist for Mr. Thaci to stay in close contact with his parents and other members of his family, such as visits, calls, and corruption. The manager suggests that, in an extraordinary way and in view of the conditions of demand, (i) for February 2025, [the February 2025] REDAKU]; and (ii) Prison Management Unit can enable [to] REDAKU] additional video visits, total, with [ REDOXED], if required, me [ REDAKUED February 2025”, the decision says.
In addition, the administration had presented that in case Thaci is released temporarily he should be limited to visit on a day and have limited time to meet his father, a family member who should be identified as his father's guardian. It was also mentioned that this visit be realized under secret conditions.
As a result, the ruling says that the panel is not convinced that Thaci's father's current medical situation is considerable, given that he has been hospitals. However, it says the panel has come to conclusions that Haxhi Shala has stabilised and he has been released from the hospital and information on the request that his defeat is serious at this moment.
“Although Thaci's defence stresses recommendation in the medical report that Mr. Haxhi Thaci must be “ [ REDAKUED]”, there is no information in demand suggesting Mr. Haxhi Thaci has needed re-hospistalization or that his condition is deteriorating. The panel notes that Mr. Haxhi Thaci is elderly and has health concerns, but, as it has been said, there is no information in the request to show that his illness is serious at this point”, the decision says.
In addition, the panel recalled that there is an ongoing climate of witness intimidation and intervention in judicial procedures, as Thaci himself allegedly was part of such a process by offering information about unauthorised persons for what he already has an indictment.
“Z. Thaci has been charged with all but the charges in these procedures for crimes against the administration of justice and public administration and crimes against public order for claiming he has uncovered classified information given him in this judicial process and, along with others, has co-ordinated to illegally influence the testimony and/or contact of SPO witnesses in this case”, the verdict says.
As a result, the panel has found that given all the circumstances, Thaci's father's medical condition does not constitute strong humanitarian reasons that could justify Thaci's provisional release.
While, to stay in close contact with the Thaci family, the administration was ordered to enable additional video connections with some people from the close family whose names are edited to the public.
And in the decision of the preliminary procedure judge, Marjorie Masselot, she is said to be aware of the fact that Thaci's father is in a delayed age and his general health condition is deteriorating.
“However, the Pre-Plain Judge points out that Mr. Thaci has been released from the hospital on [ REDAKUED January 2025 “in a stable health state”. He's been admitted back to the hospital anymore. REDAKU], me [ REDAKUED January 2025 and was again released on the same day, with the recommendation that [ REDAKUED]”, the decision follows.
She had noted that from Thaci's defence, she had received no information whether Thaci's father's condition has deteriorated weeks when he was released for the second time from the hospital. As a result, the request submitted to Judge Masselot had also been rejected.

The indictment says Thaci has led and participated in these efforts through his visits to detention facilities during the time he was detained under his trial for war crimes and crimes against humanity.
It says that members of the Fazliu Group, the Smaj Group and the Kilaj Group were co-ordinated to influence SPS witnesses during the unprincipled visits of July 2nd, September 9th and October 6th 2023.
