Four judicial institutions declared illegal: How did the Government defend him for almost three years, Iron Nikchin, who was imprisoned yesterday?

The Kosovo government for nearly three years, unpredictably, has defended its illegal decision to appoint Hekuran Nikci to the position of chief inspector of the Labour Inspectorate. He, who was arrested yesterday, has disputed the decisions of all courts of the Republic of Kosovo. Although four judicial institutions had ascertained that he had taken this position contrary to the laws in force, the Ministry of Finance, Labour and Transfers continued to keep him in office.

The KPMSCK findings, the Constitutional Court, the Court of Appeals and the Supreme Court, showing Nikc's position was being held illegally, for Kurti Government had no value.

By the end of last year, Nikchi had even refused to release his office. The National newspaper has secured a decision signed by Deputy Inspector Agim Milaku, where Nikci was asked to hand over the seal and all the tools, but the same had refused to do so.

The Nacional newspaper has sent several questions to the finance minister to ask for clarifications on why court decisions have not been implemented, but this ministry has not provided clarifications.

This arrogance of government seems to have ended yesterday, when Iron Nikci was arrested and sent to the hold for 48 hours.

The Constitutional Prosecutor in Pristina has suggested that Iron Nicki is suspected of three criminal acts.

History of the Issue

In the Act of Appeals, which was provided by the Nacional newspaper, the complaint of the Ministry of Finance, Labour and Transfers was denied.

The bias in question shows that the Constitutional Court Act in Pristina remains in force, which assessed the KPMSCK ruling as fair.

Following an extraordinary Monitoring at the Ministry of Finance, the Independent Council for the Civil Service of Kosovo has concluded that the appointment has been made against the law in force for public officials.

According to the Council's decision, no public contest was announced for this position, which is required with the Law for Public Officials.

The council had found that the position of Chief Inspector of the Labour Inspectorate enters the category of high-level leadership positions within civil service, and as such is subject to the Law's Law regime for Public Officials.
