The Constitutional Court in Pristina on Wednesday has been given the opening word in the trial against war crimes indictees in Panorc, Malisheva, Srdjan Lazovic. Initially, witness Ramadan Bacaj before the court confessed the persecutions experienced by Serbian police and military forces and how they were expelled from the village of Panorc, reports “Justice Vow”, broadcast Periscope.

On September 3rd in the afternoon, an unprecedented horror occurred, surrounded us, we were in Panorc, surrounded by Serb police and military forces. The Witness Bacaj claimed to have been tortured on the way to school.

The next day we've all been thrown into the school yard, and we're sitting on our knees. Bacaj said there was also the accused Lazovic, who had been tortured.

Then was witness Zaim Gashi, who confessed the persecutions he had experienced, also describing what his friends had told him.

The Witness Gashi also mentioned the journey when they were separated and sent to school, accompanied by Serb forces in Panorc.

Initially, special prosecutor Armend Zenelaj stated that during this trial, the testimony of dozens of witnesses will be heard, detailingly describing the actual situation presented in the indictment as well as the role of the accused.

“Today, we are here to seek justice for about 500 citizens of Albanian nationalism, who from September 3rd to September 5, 1998, in the village of Panorc, the Malisheva municipality by Serb police and military forces -- including the accused -- have been separated from women and children, arrested, tortured by being held about 30 hours illegally arrested, in serious living conditions, denying them the fundamental rights of”, prosecutor Zenelaj said.

The prosecutor stressed that these dates had become the expulsion of the civilian population from their homes under gun threat, forcing them to unite in columns to flee in Albania.

By contrast, the Special Prosecutor of the Republic of Kosovo (PSRK), on November 19th, 2024, has filed charges against defendants Srdjan Lazovic, for war crimes during 1998-1999 in the village of Panorc of Malisheva municipality.

According to the indictment provided by “Justice Trust”, Srdjan Lazovic is charged in 1998 period of international law, during wartime in Kosovo, in the village of Panorc, Malisheva municipality, acting in co-ordination with still unidentified persons, violated international law rules and carried out arrests and illegal deprivation from freedom, physical and psychic abuse.

In this indictment, ways and circumstances of mistreatment and arrests of the Albanian civilian population have been described, which were not involved in war.

The indictment reportedly states that from September 3rd 1998 to September 5, 1998, in the village of Panorc, the Malisheva municipality, deliberately armed, uniformed, in co-ordination with other members of Serbian police and military forces, with the intent of intimidation, mass deportation and ethnic cleansing of the Albanian population, Lazovic has arrested, detained, tortured, physically and psychologically tortured, about 500 civilians, who were not involved in the conflict.

It says that residents of the villages of Malisheva and Cline, along with their families, had been forced to leave their villages and houses, heading towards the mountains of the village of Panorc and most reached in the village of the civilian population, face a roadblock of Serb police forces, who had surrounded the area where the civilian population was located, where Serbian forces are said to originally separate men and children from women, these are giving them orders to leave and some 500 Albanian males are arrested and sent to the village school where they persecute and beat them in their midst, including Ahmeti.

With these, Srdjan Lazovic is accused of co-ordinating, committing the criminal work “War Against Civil Population”, sanctioned with Article 142 concerning Article 22 of the Socialist Republic's Federalist Republic of Yugoslavia's Federal Law (now “) LP-RSFJ” as a law in effect at the time of the conduct of criminal acts.
