Vjosa Osman's sister was licensed for a lawyer without meeting the terms

To be licensed as a lawyer in the Kosovo Lawyers' Oda, certain procedures must certainly be followed and certain conditions must be met. This has been confirmed by the Oda of Kosovo Lawyers himself, where it says that in addition to other required documents, during the license application as a lawyer is also required by “Declaration or the realisation of unemployment”, which is obtained at the Employment Agency.
But how these conditions seem to apply only to someone, while there are times when exceptions are made, as in the case of Blinera Osmani, the sister of President Vjosa Osmani.
Blinera Osmani's name exists on the list of attorneys licensed by the Oda of Lawyers, so the same exercises the lawyer's profession with licenses, but, as Nacional reports, the same has never handed over to the Oda of Lawyers “Declaration or to prove unemployment”.
National has asked for access to public documents from the Employment Agency, where it has provided Blinera Osmani's request to this Agency to be equipped with confirmation of non-resistant labour relations.
Blinera Osmani's request was submitted to the Employment Agency on July 18th of 2023.

On July 21st of that year, the Employment Agency had replied to Blinera Osmani by refusing to apply for equipment with the Declaration of Disemployment, since the same, according to the Employment Office assessment, has been found to be unrecognitional and has never been registered as unemployed or actively sought work at the Employment Office in Pristina, so it could not be issued on the Declaration of Unemployment.

The employment agency's response also points out that through evidence generated by the ARBK system, Blinera Osmani is a owner and authorised representative in two businesses, while in a business, he is authorised representative.
This was confirmed by the Employment Office on July 18th, where it was found that in business “First Legal Solition KPS”, Blinera Osmani is owner or shareholder and holds the post “Director”.
In business “Pirrac - U6-The branch in Kosovo”, Blinera Osmani was found to hold the position “Registered Agent”, meanwhile in business “BO Legal Consulting KPS”, Blinera Osmani held the position of Director Manager.

The three businesses mentioned, according to the Employment Agency's findings, were active at the moment of verification, while according to the registry provided by ATK, it was estimated that Blinera Osmani has accepted primary salary from business “BO Legal Consulting KPS” from January 2022 until June 2023.
As a result, this Law on Registering and Offering Services for the Jobs, Employers, and Employers had concluded that Blinera Osmani could not be offered the Declaration of Disemployment.
After the first response received from the Oda of Lawyers, this medium had requested additional clarification on how the Blinera Osmani license had been enabled as a lawyer, without completing the documentation, so without the letter you need and never fought, but the same have never returned.
On the other hand, Blinera Osmani has denied all claims, but he has not confirmed whether he received the Declaration of Unemployment from the Employment Agency, has he?
“Allow me to stress that during the entire process of application for legalisation, I have fully respected all criteria and procedures defined by legislation in force and by Kosovo's Oda Law regulations. Since 2021, I haven't been in a business relationship in the legal sense of this term, so I haven't had a job contract with any employer. In accordance with this fact, during my application I have presented all relevant evidence proving a lack of employment, as required by Oda and the applicable legal provisions. It is important to explain that under the Law of Labour and Legal Practice in effect, the work relationship is created only through a work contract bound between employers and employers. Hence, ownership of stocks in a commercial society is not a business relationship and does not create any of its legal effects. Being a shareholder in a legal subject cannot be interpreted as employment, either legal or material, so it's the same as possessing real estate that doesn't amount to work. Owner of property, then, is not a business relationship. In the concrete case, none of my assets in the stock has been of the nature of employment. As a result, there was no legal or actual barrier to prevent my license as a lawyer. The Commission for License to the Oda of Kosovo Lawyers, after full review of relevant documentation and verifications, has approved my request in full compliance with the criteria and legal norms in force, which clearly testifies to the correctness and transparency of the process.
