Gzim Shala, senior researcher at the Kosovo Institute for Justice (IKD), has said the Kurti 2 government is in office and has no right to propose the budget, nor the Parliament has the right to propose the government budget in office.
Shala has said the Law for Government says the government in the resignation has the right to propose the adoption of the Kosovo Republic of Kosovo budget”.
But, he says Kurti 2 government is in office, not government in resignation.

In this regard, Article 30.2 points out: “The government in the resignation is considered in the following situations: 2.1. After the distribution of the Assembly until the election of the new government; 2.2. After resigning the prime minister or any other case in which the prime minister post remains at large until the election of the new government in accordance with Article 95 of the Constitution, and if this is not achieved, until the situation defined in paragraph 2.1 of this article; 2.3. After the successful vote of no-confidence motion on the part of the Parliament, until the election of the new government.” None of these situations apply in the case of Kurti Government, which is the Government in office and not the Government in resignation. The government in resignation refers to a government that has been elected by a designated legislature, which continues to work until the moment of the new government's election, rather than in cases when the Government has completed its mandate. In the concrete case, the government in office has not been elected by this legislature and does not belong to it. Therefore, the incumbent government has no right to propose the budget, nor does the Parliament have the right to vote on this incumbent government's budget proposal”, Shala wrote on Facebook.
Even incumbent Prime Minister Albin Kurti has said on Monday there is uncertainty about how the budget process will be continued.
A budgetless country is a country that cannot move forward. We have the right to propose the budget for 2026 in the Parliament under the Government Law, but we also have to do a lot of consultation with lawyers to see what the road before” is, Kurti said.
Kurti has said the problem at this stage constitutes the fact that parliamentary commissions have not yet been formed, and has expressed fears whether the content will be approved in the Assembly.
There are many unknowns on the road ahead, and yesterday added them”, he said.
Without the formation of the Assembly commissions, the budget will not be executed in the beginning, nor will it be based on current budget projections.
