Krasniqi said the incumbent government cannot propose the draft draft of the Annual Budget for the new legislature.
“While the incumbent government is the government elected by the preliminary legislature, which has no institutional connection with the new legislature coming out of the election.
Under the Law on Government, the government in resignation can propose the budget bill, while this right is not recognised to the incumbent government”, he wrote among other things.

The incumbent government elected by the preliminary legislature cannot propose the Annual Budget Bill for the new legislature.
The Assembly, which has not yet elected the new government, cannot pass laws without having its government implementing them.
Adjusting the Assembly envisions the draft budget being reviewed through parliamentary commissions that have not yet been established.
Any deviation from this procedure is a clear violation of the Order. Article 123 allows only avoids procedural deadlines, but not from essential actions such as reviews on commissions or proposals from the legitimate government.
The difference between government and government in office must be made clear:
The government's resignation is that, during its mandate, following the prime minister's resignation or dismissal, continues to exercise positions until the new government is formed, still having functional frameworks, established commissions and government communications channels.
While the government in office is the government elected by the preliminary legislature, which has no institutional connection with the new legislature coming out of the elections.
Under the Government Law, the government in the resignation can propose the budget bill, while this right is not recognised to the government in office.
Respecting the procedures is not a formalisation ʹ is the essence of power sharing and democratic functioning of institutions.
