Constitutional measures government's decision on some properties in Gracanica

The Constitutional Court has announced that on October 21st 2025, it has decided to continue its interim move in the case of K84/25, adopted on July 31st 2025, in length until October 31st 2025.

The request has been submitted to the Constitutional Court by the Gracanica Community, based on authorisations defined through paragraph 4 of Article 113 of the Constitution of the Republic of Kosovo, through which the decision has been rejected. 05,218] Government of the Republic of Kosovo of August 28th, 2024, for <x0 council in public interest building the residential centre for autism, Ashdown syndrome and limited capacity for children, adults and procrastinated age. ”

The court says it deemed it reasonable and proportional to the continuation of the provisional measure until January 30th 2026, against the controversial decision because it serves “eviation of risks or irreparable damages” and is in “public interest”.

The court, through its ruling on the continuation of the provisional measure, stressed that this decision applies to all parties and does not in any way prejudge the merits of demand.

The court, on October 21, 2025, unanimously ruled:

I. T A V AZYDY the provisional motion approved on July 31st 2025, to continue suspending implementation of the decision [N.05,218] approved by the Government of the Republic of Kosovo on August 28, 2024;

6 / 1 T A PUBLEK this decision in Official Journal, in accordance with paragraph 4 of Article 20 of the Law;
