Two charged with hooliganism in 2021 in the north, four others declared innocent

The six accused are charged that on October 13th, 2021, members of crowds gathered in northern Mitrovica, where they have hit with stones, wooden bars and metal, as well as hand grenades with police and Customs members, reports the “Justice Betrimy“.

Later, indictee Nenad Milkovic's defender, lawyer Haxhi Milaku, said his defender has been informed of all circumstances, and this plea is free will, clarifying all the consequences and benefits of admitting guilt.

Lawyer Millaku proposed that in case his defense is pronounced a prison sentence, he will be replaced by fines.

On the other hand, Aleksandar Lazic's defender, lawyer Jelena Krivokapiq, said she supports her defender's decision to plead guilty and stressed that it has been his subjective wish for guilty admission. He said he was cleared of the consequences and benefits of admitting guilt.

Even Krivokapiq said that if accused Laziq is sentenced to prison, he demanded that he be replaced in prison.

Later, prosecutor Shala said she agrees with the plea on the part of the two indictees and that the same has been done in line with criminal procedure provisions.

It proposed that the admission of guilt be taken as a facilitating circumstance in the case of the pronunciation of criminal sanctions.

Later, Judge Vesel Ismaili approved the guilty plea for the two accused and singled out the procedure by other indictees.

Judge Ismaili announced four indictees who were declared innocent that in the 30-day term, they have the right to file a request to drop an indictment and to challenge evidence.

Parasely, defender of accused Ilija Vifjjetevic, lawyer Emrush Kastrati said he did not accept the subject paperwork, except for the indictment.

Prosecutor Arbresha Shala said she has distributed the announcement to all defenders to get the subject paperwork, but not all were submitted.

On the other hand, lawyer Kastrati said no one has reported on going to get the evidence for the case.

After a panel of judges, to consult about the hearing proceedings, lawyer Kastrati agreed that the hearing would continue in hopes that the prosecution will submit all evidence to the case via e-mail.

Afterwards, prosecutor Shala said the prosecution would hand over the paperwork with a ballot.

“There is a well-founded suspicion that defendants, in 13,10.2021, have deliberately participated in crowds gathered from about dozens of people in northern Mitrovica, whose numbers have grown and decreased depending on their movements, and have hit with stones, wooden and metal bars, as well as hand grenades, members of the Kosovo Police and Customs, causing general danger. According to the indictment, they were ambushing police at the site of the event by setting barricades, while police armoured vehicles were hit with bullets from gunfire and hand grenades. As a result, the B.A., E.V. and S.A., members of the Kosovo Police, have suffered bodily injuries”, the report said.

According to the prosecution, on the same day, defendants Ilija Viqjjetevic, Milan Viqjjetevic and Marko Rakiq, in the neighbourhood “Bedjane”, have attacked police and customs officials with gas balloons, and with firearms in their direction and official vehicles.
