or almost three years since the State Attorney is led by a task attorney.
Following President Vjosa Osmani's decision in October 2023 on the failure to read Blerim Isufaj as chief state prosecutor, the presidency did not reveal when the issue will be addressed.
Lawyer Anton Noecaj says President Osmani's decision shows the unwillingness to empower rule of law.
“The failure to make a decision on the chief prosecutor's appointment process even on the part of the president shows a failure to strengthen rule of law, President Osmani has everything in his hands to turn to zero or decree the chief state prosecutor. Taking into account the fact that the state chief prosecutor's position is the most important and legally the most powerful position in the country and that the whole war is who will control the person who will have that position”, he has declared.
Although the task leader has full competence, IKD Executive Director Ehat Miftaraj says the decision has a negative effect.
It's disturbing because it shows the integrity of the prosecutorial system itself. We know that the president has returned negative answers to the Kosovo Prosecutorial Council that he will not decree the proposed candidate. Both the European Commission's report and the reactions and statements of our international partners and civil society have been that the Kosovo Prosecutorial Council without delay begins a new process of appointing Chief State Prosecutor”, Miftaraj said.
Jurist Noecaj says the failure to elect Chief State Prosecutor is a struggle for intervention in the justice system.
It has been a government war for three years to dictate who should be the country's chief prosecutor. This struggle for this position is not only intervention in the justice system, but also a tendency to capture the justice system, collapse of democracy and return to the country's journey towards European integration. ”
Prosecutor Besim Kelmendi is the task officer of the State Attorney.
President Vjosa Osmani did not decree Blerim Isufajn, arguing there were legal violations during the selection, which was rejected by the KKP.
The process of selecting the chief state prosecutor had prompted numerous reactions, and some of the non-governmental organisations had demanded repeat the competition. /Time
