Innocent accused of robbery of nearly 1m euros and over 46 thousand dollars

The accused Berisha, who is also in charge of illegal weapons possession, has pleaded guilty. While accused Sogojevo has also been declared innocent of import, export, supply, transport, production, exchange, mediation or weapons or firing matter.

Later, court chairman Vesel Ismajli said the accused and their 30-day defenders have the right to submit the objection to evidence and request to drop the indictment, reports the “Justice Vow”.

Also in this session has been set aside the procedure for accused Nedzat Muqoll, who is being charged with criminal acts “Taking on or organising a criminal group and robbing and using dangerous weapons or tools”.

The isolation of the procedure against Muqolli was done with his defender's proposal, lawyer Musa Kongjeli, who said the same is in health treatment abroad.

Otherwise, the previous hearing in this case had failed to be held in the absence of both indictees.

The Constitutional Prosecutor in Gjilan on March 13th 2024 has filed charges against indictees Dardan Gashi, Milaim Lipovica, Kufrim Jaka, Agron Berisha, Victor Sogojevo and Nexhat Muqolli.

At the first point of the indictment, it is said that on November 18, 2021, in the village of the Novoberda municipality, defendants as a criminal group had robbed the amount of money of 996 thousand and 271 euros and 24 cents and 46 thousand and $780 dollars at the expense of the injured: Bank Pro Credit and company “Security Office”, both set in Pristina.

According to the indictment, accused Dardan Gashi had secured the car “Vovlo” and had put him in service, while accused Milam Libovica as company manager “Security Office” had prepared the special vehicle for willing money transportation and that without knowledge of the company's owner, the vehicle sends him to the owner of the company, with the accused owner, Koka fraud.

The Actakuz says that the vehicles put the electronic device for remote deactivating the engine through correction, after which they test it inside the bar as well as on the streets of Pristina. It says that on November 18th, 2021, the accused with the car “Volvo” and “Zefira” that were parked in the garage of the accused Jaka, with two vehicles of the accused Agron Berisha, Victor Sogojevo and Nexhat Muqolliva, and one of the other defendants, via the secondary route from Pristina to the village of Paralova and 200m from the Pristina-Gjlan street to hide the <x4V5> car, and Nexha <6Zaf>

The indictment reportedly after meeting the “Fiat” vehicle, which had collected money from the ATMs in Ferizaj, Viti and Gjilan to be sent to the ProCredit Central Bank in Pristina, with the car “Zefira” placed behind him. After arriving at Paralova, “Fiat” is stopped by wiretap, where the motor of the vehicle goes out, with the car “Zafria” facing the car “Fiat”, and first come out to the accused Viktor, Agron and Nexhat, disguised and armed with long-cashnikov weapons.

According to the indictment, the same goes to the “Volvo”, puts the bags in cash, and then burns the car “Zefira” and continues on their way to Pristina, so that in the village of Slovia, money comes out of the bag, while bags are thrown at the edge of the road and follow the way to Pristina.

The indictment says that the car “Volvo” sends and leaves abandoned to the village of Harilaq, where 3-4 days later it was identified and seized by the Kosovo Police. With these actions, the accused as a criminal group have caused damage to ProCredit Bank and company owner “Bese Security” -Abedin Hasan in the amount of 996 thousand 271 euros and 24 cents and 46 thousand 780 US dollars.

Therefore, the accused are being charged with criminal work “The participation or organisation of the organised criminal group” by Article 277, paragraph 1 of the Kosovo Republic's Penal Code (KPRK), which, in co-operation, committed criminal work “Robbery” from Article 317, paragraph 3 and Article 31 of KPRK.

On the other hand, according to the indictment's two point point, defendants Viktor Sogojeva, Agron Berisha and Nexhat Muqolli, with the same date and time as at the first point of the indictment, in case of a criminal bank robbery, had without permission held and used the Kalashnikov AK 47 weapon.

For this, Sogojevo, Berisha and Muqolli are also being charged with criminal veracity “Using a dangerous weapon or tool” from Article 367, paragraph 2 concerning KPRK paragraph 1.

On the other hand, according to the indictment's three point, the accused Berisha is again charged that on January 17th, 2023, following the court's decision-made raid, his weapon, “, had been found at his house. TT-M-57” and 13 bullets.

For what, it's also being charged for the criminal work “ownership, control or unauthorized possession of weapons”, from Article 366, paragraph 1 KPRK.

And all in the end, according to the indictment's fourth point, accused Viktor Sogoyev during the year 2022 indefinitely and on January 17th, 2023, had gone to Belgrade, Nis, killed and Presevo, where he was constantly supplied with weapons by buying several AK-47 automatic rifles, semi-automatic sniper rifles, cruise gun, several kinds of pistols and 4 thousand bullets, since he had sold them in Kosovo at prices from 600 euros to 900 euros, depending on the type and ammunition of 0.50 per cent piece.

On the case of the raid under the court's ruling, two caricators, 13 rounds, 6 shellings, and a rifle cod, say the indictment.

So for these actions, Sogojevo is also being charged with criminal work “Export, supply, transport, production, exchange, mediation, or firing matter” from Article 364, paragraph 2 concerning paragraph 1 with KPRK Article 77.
