Case “Toka”, Court clears Azem Syla, first prison sentences for several others charged

A little earlier was the court's act on Pristina's part of the court, known as "Toka" where 18 people have been charged, including Azem Syla. In addition to Syla, the other names are Shaban Syla, Arton Vila, Shpresim Uka, Ramadan Uka, Avdurrahman Brajshori, Gazmend Gashi, Lubisa Vujovic, Sabed [...]

Besides Syla, the other names are Shaban Syla, Arton Vila, Shpresim Uka, Ramadan Uka, Avdurrahman Brajshori, Gazmend Gashi, Lubisha Vujovic, Sabidin Haxhiu, Avni Maxhuni, Elhame Uka, Lumnije Soopjani, Nyrtene Brajshori, Sami Macedonci, Nsu Palushi, Ramadan Mavraz Syla and Vidovakovic.

The Court's decision has confirmed the alienation of property for some of the accused, while others have failed to prove it.

Among those released is Azem Syla and Gazmend Gashi, who were acquitted of organised crime and fraud.

In addition, in a case other than Azem Syla, Gazmend Uka and Uka Hope have also been acquitted of inciting the abuse of office or official authority and illegal enforcement of judicial decisions.

According to the indictment, accused Shaban Syla was convicted of organised crime, legalisation of false content, fraud and constantly laundering of money, being sentenced to 7 years in prison and 50 thousand euros in fines.

The accused Shpresim Uka was found guilty of legitimate crimes, legalisation of false content, fraud and money laundering in co-ordination, where he was sentenced to 7 years in prison and 50 thousand euros in fines.

The accused Lubisha Vujovic was convicted of organised crime, fraud and legalisation of false content and sentenced to 4 years in prison and 20 thousand euros in fines.

For the accused, Ndue Palushi has been charged with legalising false content because of reaching the prescription.

However, accused Ilaz Syla was found guilty of provisions 23 and 24 of the indictment for money laundering, fraud and organised crime, and sentenced to 3 years in prison and 10,000 euros in fines.

Indictee Arton Vila was convicted of organised crime and money laundering, sentenced to 5 years in prison and 40 thousand euros in fines

And Ramadan Uka was found guilty of organised crime, fraud, money laundering in co-ordination, being sentenced to 5 years in prison and 40 thousand euros in fines.

On the other hand, Abdurrahman Brajshori was convicted of organised crime, fraud and money laundering and sentenced to 3 years in prison and 30 thousand euros in fines.

The accused Sabidin Haxhiu was found guilty of abuse of office, and was acquitted of taking a bribe in succession and money laundering. He was sentenced to 1 year in prison.

In contrast, Vidosav Novak was convicted of organised crime and fraud, sentenced to 4 years in prison and 20 thousand euros in fines.

Indictees Avni Maxhuni, Lumnije Soopyan, Elheme Uka, Sami Macedonci, Nurtane Brajshori, Nrue Palushi and Ramadan Mavray were acquitted of money laundering. Also, Shaban Syla, Azem Syla and Avni Maxhun were acquitted of tax evasion.

At the June 10th, 2022 session, Azem Syla and others have been declared innocent in connection with the criminal acts that were imposed on them. The defendant F.G., on the other hand, was not declared by his lawyer, Gezim Kolzak, that his client has psychiatric expertise that proves he is unable to understand the indictment.

The Special Prosecutor of the Republic of Kosovo (PSRK) has filed two charges, one with 17 people and the other with 22 persons, which, in the latter, was established on October 24th 2016, includes the former delegation. PDK Azem Syla, who according to the SPRK, had also been leader of this group.

Syla and I have also been judged in the process by Shaban Syla, Arton Vila, F. G, Shpresim Uka, Ramadan Uka, Avdrahman Brajshori, Gazmend Gashi, Lubisa Vujovq, Sabedin Haxhiu, Avni Maxu, Elhame Uka, Lumnije Soopjani, Nyrtane Brajshori, Sami Macedonci, Nru Palushi and Ramadan Mavrej.

Part of this act has been N.U., U.S., Ilaz Syla, Mustafe Haliti and Hajrullah Berisha, but for the first two, procedures have ceased after they've changed their lives, while because the court has failed to ensure the presence of Ilaz Syla, Mustaf Halit and Hajrullah Berisha, procedures have been set aside for the same. But, Judge Arben Hoti, outside the hearing, has joined the procedure for accused Ilaz Syla and Vidosav Novakovic, where, for the latter, he has said the evidence is related and the case is the same.

The instance charged the defendants with criminal acts “organised <x8x1>, “money laundering”, “mitos”, “heavy malarmim”, “taskDetermiming”, “reference to illegal judicial decisions”, “Malformed use of the official post”, “, <x14delegisation of the counterfeit context <x> and <166>

The defendants were also charged that, in co-operation, through criminal activities, they have deprived Kosovo of social properties, including forging official decisions and documents, fraud and other corrupt actions. Investigations in this case were also made in co-operation with the High Prosecutor for Organised Crime in Belgrade.
