Council for the Protection of Human Rights and Freedoms ( KMDLNj has reacted sharply to the recent actions of the Special Court, naming it a <x0-racist institution, on the Constitution and on the state”.
In his reaction, KMDLNj has condemned the arrest of former KLA member Fadil Fazliu, former AKI chief Bashkim Smaj, former Malisheva leader Isni Kilaj and raiding the house
Hajredin Kuci, stressing that these actions have been conducted unfairly and politically motivated.
Kosovo's “Police are participating in the quality of the physical worker, during the raids and arrests of Albanians, mainly KLA soldiers and supporters of war,” is said in response.
KMDLNj considers this an unacceptable and shameful act.
In response, KMDLNj stresses that the Special Court is violating Kosovo's laws and Constitution, acting selectively and discriminated against Albanians.
This court shares justice under ethnic criteria,” is further said, stressing that over 90% of Albanian victims are not treated as such, while most of the crimes committed by Serbian forces are left unpunished.
The council describes this as an open form of discrimination and denial of justice for Albanians.
As for the judicial process against former President Hashim Thaci, Kadri Veselin, Jakup Krasniqi and Rexhep Selimi, KMDLNj states the process is dishonest and politically influenced.
No decision has been made so far in favour of the accused,” said in response, criticising also the lack of transparency and violation of the principle of presumption of innocence.
The council has noted that all visits -- whether privileged or not -- have been tapped, while requirements for a fair and impartial process have been rejected.
At the end of the response, KMDLNj proposes several measures to protect the rights of the accused, including international and local monitoring of judicial processes, refusing to answer questions under existing circumstances, and hunger strikes to distort public opinion.
“This judicial deviation is violating Kosovo's laws and judicial sovereignty brutally,” completes the response, calling for new institutions to take concrete steps to review or undo the Special Court if it does not respect Kosovo's laws and Constitution.
