Miftarian: Special Court arrests are meaningless

Kosovo Justice Institute Director Ehat Miftaraj has commented on the arrests of three people by the Special Court, stressing that these arrests are unclear. Miftaraj has indicated that information that had witnessed preventing the administration of justice from such individuals was insufficient to support such a decision. “IKD continues [...]

Miftaraj has indicated that information that had witnessed preventing the administration of justice from such individuals was insufficient to support such a decision.

“The IKD has consistently indicated that the integrity of the judicial procedure is guaranteed by protecting witnesses, judges not only in The Hague but also in Kosovo, should ensure that procedures are carried out unhindered however in the way we saw it and that three days' detention sessions were held that it is meaningless that the Special Court has argued that there has been information that the same persons have obstructed the administration of justice from the beginning of 2023 to the end of 2024, and that only in this phase of making such a decision is uncontainable and that we are not understood. Moreover, we need to understand the fact that by March-April of next year it is pre-priced for prosecution witnesses to close up the subject and give their testimony”, Miftaraj has indicated.

Miftaraj has stressed that, at this stage of the judicial process, it is meaningless to see such arrests. He acknowledges that the law does not prohibit such an act, but Miftaraj hopes that the prosecution's frustration has not influenced the recent actions taken by the Special Court.

At this stage, at the end of this court process, seeing such a thing for us is meaningless that it is true that the law does not prohibit it. We don't want to prejudge the case at this stage, but based on what we've seen as IKD monitoring this court on a daily basis, and we're reporting on any session that was held, we can say that random prosecutors are at least seen not very pleased with the work we've seen a large number of prosecution witnesses in a way have given evidence that went in favour of defense, we want to believe that this frustration of the prosecution is not impacted even in the last few actions that were done in the last days of the end of the country's 148x>, he has stressed.

On the other hand, he has said that the judicial process is going towards the end, stressing that the outcome with defence witnesses could bring a “liberation” for both Kosovo and the defendants.

He stressed that a conclusion of this process -- at least in the first degree -- would be an important step to justice.

It is good to see the trial process last by itself as witnesses to the Prosecutor's Witnesses conclude in March-April, beginning with witnesses of the victims' defenders then to end with defence witnesses, we can say it could be a release for both Kosovo and defendants for this process to reach a at least one degree. Without wanting to prejudge, we want to believe in finally gaining justice, and the process to have the integrity and confidence of the public so that whatever decision is made to receive the blessing that this decision touches, but also the trust of citizens of the Republic of Kosovo”, he has said.

Otherwise, the Special Prosecutor on Friday has arrested the former head of the Malisheva municipality, Isni Kilaj, former AKI chief Bashkim Smaj and Fadil Fazliu, brother of martyrs Fahri and Bahri Fazliu.
