Former Leposaviqi chairman sentenced to 3 years in prison for corruption

In this case, the indictment tasked former Leposaviqi leader Dragan Jablanoviq with participating or organising the organised criminal group and misusing the official position or authority, along with Haxhi Bata, Aleksandar Ackovic, Aleksandar Kostic, Cedomir Timotovic, Bojan Banovic, Miroslav Ivanov, Ivan Cadiq, Boban Milovanov. While accused Xhemajl Feriz, Haki Haxhiu, Mehdi Haxhiu, Mensur Rama and Nijazi Musliu were charged with criminal acts of participation or organisation of the organised criminal group and misuse of economic authorisations.

The indictment was proclaimed Thursday by the chairman of the court, Violet Namani, reports “The Justice Act”.

Indictee Dragan Jablanovic, for the criminal act “The use of official position or authority”, was sentenced to 3 years in effective prison, which sentence will be executed after the integrity of this act.

While accused Haxhi Bata, for criminal offence “The use of official position or authority”, was sentenced to 2 years and 6 months in prison, which sentence will also be executed after the integrity of this sentence.

Indictee Aleksandar Ackovic, for criminal work “Using official position or authority”, was sentenced to two years in effective prison. The sentence will be executed after the full might of this act.

The same was submitted to supplementary punishment, the ban on public office exercise in public administration and public service for two years, following prison sentences.

Indictee Aleksandar Kostic, for criminal work “The use of official position or authority”, was sentenced to one year in prison, which will be executed after the integrity of the act. The same is pronounced complete punishment, the ban on public office exercise in public administration, or on public service during the duration of 1 year, following prison sentences.

Also, accused Cedomir Timotievic of criminal work “The use of official position or authority” was sentenced to 2 years in effective prison. Even this one is executed after the full might of the act. The same is pronounced complete punishment, the ban on public office exercise in public administration, or on public service in terms of two years after the prison sentence was held.

Bojan Banovic, for criminal work “Using official position or authority”, was sentenced to 2 years in prison. He is pronounced a complete sentence, a ban on public office exercise in public administration, or on public service in two years after serving a prison sentence. The prison sentence will be executed after the court becomes all-powerful.

Miroslav Ivanov, for criminal work “The use of official position or authority”, was sentenced to two years in effective prison, which sentence will be executed after the court becomes all-powerful.

The above-mentioned indictees, for the “Using official task”, have been convicted of carrying it out in co-ordination.

In contrast, accused Ivan Cadiq, for criminal work “Using official position or authority”, was sentenced to 6 months in effective prison. This sentence, with his consent, could be replaced by fines of 5 thousand euros. His sentence is executed after the judgment becomes almighty.

The same is pronounced complete punishment, a ban on public office exercise in public administration, or on public service during the duration of one year.

Indictee Boban Milovanovovic for criminal work “Use of official position or authority” was sentenced to 6 months in effective prison. This sentence, with his consent, can be replaced by fines of 5 thousand euros. His sentence is executed after the judgment becomes almighty.

He too is pronounced a complete sentence, a ban on public office in public administration, or on public service during the duration of one year.

The high-ranking indictees have been found guilty of the criminal offence of “Use of official position or authority” in co-ordination and continuation.

Indictee Xhemajl Ferizi, for criminal work “Using economic authorization”, is sentenced to 500 thousand euros and prison sentences of 2 years. The sentence will be executed after the judgment becomes almighty.

Also, accused Haki Haxhiu of criminal work “Using economic authorization” is sentenced to 500 thousand euros in fines and prison sentences of 2 years. Likewise, the sentence will be executed after the judgment becomes almighty.

Indictee Mehdi Haxhiu, for criminal work “The use of economic authorization”, is sentenced to 500 thousand euros in fine and prison sentences of 2 years, which the sentence will be executed after the sentence becomes overwhelming.

Even Mensur Rama, for criminal work “Using economic authorization”, is sentenced to 50,000 euros in fines and jail sentences of a year. The sentence will be executed after the judgment becomes almighty.

And in the end, Nijazi Musliu, for criminal work “The use of economic authorization”, is sentenced to 100 thousand euros in fines and imprisonments in six months, which with the consent of the accused could be replaced with fines in the amount of 30,000 euros.

According to the Court, the elements of the criminal work “The participation or organisation of the criminal group” were not manifested, so the accused were acquitted of this criminal offence.

Each of the accused is committed to paying the amount of 500 euros, as well as the amount of 100 euros for the victims' compensation fund.

While, the representative of the damaged and state-run side of the Justice Ministry, for predicting a wealth of judicial demand, is directed to civil conflict.

Disgruntled parties have the right to complaint at the Court of Appeals through the Foundation Court in Pristina.

Otherwise, at the September 20th 2024 session, the former head of Leposaviqi, who has denied having influenced the employment of other indictees.

While accused Xhemajl Feriz, Haki Haxhiu, Mehdi Haxhiu, Mensur Rama and Nijazi Musliu, who were charged with criminal acts of participation or organisation of the organised criminal group and misuse of economic authorisations.

Otherwise, J. B, but on October 16, 2023, the court has stopped criminal proceedings against her after the same has passed away.

In the Special Prosecutor's indictment, established on September 13, 2021, it is said that all defendants have acted actively as a criminal organised group, over the period of 2015-2017, by performing serious criminal acts and given that they will contribute to the realisation of criminal activities.

Criminal work “The participation or organisation of the organised criminal group” by Article 283, paragraph 1 of KPRK fines up to 250 thousand euros and jails for at least seven years, while according to Article 2, this work is fined at up to 500 thousand euros and sentenced to jail for at least 10 years.

However, criminal work “Using official position or authority” by Article 422, paragraph 1 is sentenced to prison terms of six months to five years, while criminal acts “Kestum use of economic authorization” by Article 20, paragraph 2 is sentenced to prison terms of one to eight years.
