Five thousand euros in bail for Smaj to be released on bail

For the former head of the Kosovo Intelligence Agency, the Smajan Union offered 5 thousand euros in bail for him to be released on bail.

The request was made by the protection of accused Bas Martnes, in Kosovo's Specialised Chambers.

Lawyer said Smaj is willing to hand over his passport and report to EULEX and also respect all conditions that may come out of the judge's decision in case the motion is approved, the Justice Vow reports, Klankosova broadcasts.tv.

Martines, also declared for the reasons for the escape of the former AKI leader, who has mentioned the SPS.

The lawyer said that since the time of the raids in Kosovo last year, his client had been taken away with some items that the SPS has not returned, and therefore Smaj had realized that the Z's case had been found. The SP wasn't finished.

“Flasim for reasons: the risk of escape- is public information and you can also find in the media this information that my client was a search target on September 30th more than a year ago. Several items were confiscated back then, his house was searched, but he was not arrested at the time. Apparently, he wasn't tried to get arrested right now. From this moment on, as I understand from my client, this case is not closed because many of the items that were checked and seized have never been returned to my client. So the client knew specifically what was going on right now and his case was going on by the SPS, and we knew that this was an issue to be judged by TSK because the ZPS was doing the control of his house. This is relevant for the reason you are told that there is danger of escape”, he said.

As a result, the lawyer said that since the search at his house, which was performed by the SPS, he did not leave his house and continued his life.

While for the reason for obstruction of justice, the lawyer said the indictment speaks of several isolated cases belonging to the summer and autumn of 2023.

I didn't see any other cases carried out in the previous period in the document. In fact, there is no reason to let us suspect that the client will continue to commit criminal acts he is currently suspected of. This is relevant for the fact that if the client would prevent justice, he has not done it and why he has to do something like that”, he said.

The lawyer said that based on the documents they were given, there is no information whether his client destroyed any evidence. As a result, he said there is no danger that his client will repeat the criminal acts he is suspected of.

Martines said his client is a family and should support the family and that as a requirement he had Smajt's parole by offering bail worth five thousand euros.

Prokuro said that what the lawyer said did not change their position and spoke about the case of raids the lawyer raised.

He said there is now a confirmed indictment and it is completely different from the situation when the raid was made.

The judge said she will make the decision after a brief break and is then expected to complete the session.
