Criminal charges against Fadil Nura for abuse of office, interviewed by Special Prosecutor

In the criminal records exercised by Shala-Gashi, the mayor of the municipality reportedly had changed her position from Deputy Director of the Main Centre of Family Medicine (QKMF) to Skenderaj, appointing her Secretary of Administration Service and Staff. While, in the position of deputy director, Ferat Kabashi had appointed.

Shala-Gashi, in criminal speculation, had said the deputy director's position had exercised until the arrival of the ruling Democratic Party of Kosovo (PDK).

It says that on December 28, 2021, the new mayor of the municipality, Fadil Nura, had decided that Shala-Gash would change his position by turning him into the lowest position he had ever had, the most important H-6-850. But with that date, in its position without competition, Ferat Kabashi had assigned the nurse's position to the deputy director of the QKMF, as well as to the cofficiency (H-6, 850).

According to her, for a year the two have kept the same cofficiency, so claims the mayor has damaged the Communist budget for 17 thousand and 418 euros and 50 cents from the appointment date so far.

On the other hand, according to this criminal connoisseur, after a year Shala-Gashi has requested via e-mail from Chairman Nura to return him to the position for which the contract is bound, but has not been answered. The same is said to have been addressed to the Labour Inspectorate. The latter, has cautioned and imposed President Nura to eliminate irregularities.

After that, reportedly on February 28th 2023, Nura had made the decision to cancel the competition for deputy director, forcing the department for human resources to cut off the contract on Shala-Gashi for the position and to return it to the official position for personnel and administration.
For these violations, according to a decision by the Labour Inspectorate, Nura has been fined 1,000 euros and 500 euros.

Shala-Gashi is also headed with indictments at the Constitutional Court in Mitrovica, where the first instance has approved this indictment in all to return to the post of deputy directorial work, while the case is already found at the Court of Appeals.

In criminal remarks, among other things, it is said that with the entry into force of the Law for Salaries, the institutions have been obliged to prepare the employee list to become the equivalent of the old co-aficiences with the young ones, but that Ferat Kabashi has been left without a counterproductive comment that will be considered after the completion of the trial process.

As to the exercise of criminal defamatory against him, Mayor Nura has said of “Justice Trust” that it's everyone's right if he thinks his rights were violated.

Nura says Shala-Gash has not been cut off, but only the competition and the selection procedure of KKMF deputy director has been cancelled, as according to him, the Law for Public Officials and Labour Law was violated in the process. Also, it says the Administrator Guide has been violated to regulate competition procedures in the public sector.

“Citoy-competitive public competition should be repeated if at least 3 candidates fail to meet the previous conditions in the” contest, Nura responded.

According to him, the Law stipulates that high levels of management and managerial positions are elected by a four-year term.

Nura says the competition for this position has been announced and cancelled twice, while adding that Ferat Kabashi is holding this position as task leader. Thus, the latter hold this position as a task leader since December 23, 2021.

On the other hand, questioned about the exercise of office for so long, knowing that the law allows 6+6 months for a position of duty, Ferat Kabashi said the position is held by 2022, while added that KKMF's director and KD make decisions.

The 2022's <x0.2 holds this position, since the competition has been released twice and it has been cancelled. As far as decisions are concerned, decisions are taken by the director and the QKMF Steering Council”, said in Kabashi's response.
