Court: New deal with Bahtari's guilty plea meets conditions

The chairman of the court's court, Mapie Veldt-Foglia, in court case against Sabit Januzi, Haxhi Shala and Ismet Bahitari, said the latter's new agreement on admitting the guiltyness reached with the Special Prosecutor's Office meets legal conditions. The oral “is about the guilt deal handed over by ZPs [...]
The oral “commands the plea agreement handed over by the ZPs and the defence of Bahhitari. After reviewing the new plea agreement, the court has concluded that this agreement meets the requirements of the 94 (2) rule of the Order”, the judge said.
As a result, it appointed December 18th 2024 as the session in which this plea agreement between the SPS and Bahitari will be discussed, reports “The Justice Vow “.
Therefore, the court considers it reasonable to set a session for Thursday (December 19th 2024) at 13:00, depending on the decision the court will make today on the unresolved issue to discuss Mr. Bahtyar's new agreement with SPS in order to ensure the rapid performance of the” process, she said.
As a result, Bahhitari's defense was ordered to let it know whether her client intends to make a statement in the process of the plea agreement and the very pre-emptive defence concerning the appointment of sentence.
Bahtari's defense, lawyer Felicity Gery intervened, saying their defence has no intention of making a statement. In this regard, Veldt-Foglia told him not to interrupt.
Thereafter, Bahhitari was ordered to attend the December 18th session.
The other command, however, concerned statements related to damages in guilty dealings. Initially, the court recalled that there is no framework decision regarding the participation of the victims in the case.
As a result, the Federation of Victims was ordered to receive the December 6th indictment and the confirmation decision of October 2, 2023, as well as the decision to change the indictment of July 8, 2024, that information in them should not be released. And the Administrative Office was ordered to hand them over.
According to the judge, these documents provide information for people who may be victims in the case.
The victims' participation office, according to the judge, should inform whether there are requests for participating victims, the number of requests, how direct and indirect victims, including collections of the alleged type of damage, the size of damage, information for victims, and others.
After the break, the judge said the plea agreement specifically referred to the indictment of July 10, 2024, and there is no obstacle to continuing today's session on planned issues. After several discussions between the parties, it was decided to continue with the session.
Veldt-Foglia said it would initially be continued with discussions on the plea agreement for Shala, to proceed later with Januzi and tomorrow with that of Bahhitari. According to her, other defence teams are not obliged to stay in the hall unless their client's plea agreement is discussed.
