Court condemns accused of burning Serbian flag in gym “Sheni Nushi” in Gjakova

The decision has been made after the accused has reached plea agreement with the Special Prosecutor.
The case judge, Kujtim Krasniqi, said Luzha is sentenced to six months in prison, but who with the consent of the accused is replaced by fines of a thousand euros and with the right to pay in five installments, reports the “Bettim for Justice”.
Likewise, Judge Krasniqi said that in the event of the fine penalty not paid by the accused Luz, the same will be turned into prison, where for a day imprisonment will be estimated at 20 euros.
Finally, the judge informed the parties of the right to complaint after the decision is written.
Presequently, special prosecutor Bekim Kodraliu said he stands on the whole next to the plea agreement and that the same has been linked to the authorship of chief prosecutor, Blerim Isufaj.
On the other hand, the defender of the accused Luzha, lawyer Bardh Maxuti, stated that his client has clarified all the benefits and consequences before the plea agreement is linked.
The lawyer demanded from the Court that the fine sentence be milder, taking into account Luza's poor economic situation, and that he is a family keeper.
We ask the court to take into account the extenuating circumstances as they are: the same in the initial phase of the procedure has accepted the criminal action by showing repentance, once to assess the circumstances which concern the accused's previous inconvention, that he is of the poor economic situation, once in the wake of the criminal act, and his promise that he will not conflict with the law in the future, is the father of two children, the only father of the family, lives in a house rent of<1>, the lawyer Max said.
Luzha himself said he regrets what he has taken and asking the Court for a milder sentence, adding that he is a family keeper and that he has a weak economic situation.
According to the indictment filed by the Special Prosecutor of the Republic of Kosovo on November 21, 2024, it is said that on October 23rd, 2022, about 600 in Sports Gymbore “Shani Nushi” in Gjakova, Petit Luza in co-ordination with two unidentified persons so far, with the aim of instigating, division, hatred and incompatibility among ethnic groups in Kosovo, during the development of the basketball match between the Basketball Club “Vulsonation” and Club “Tripca”, had set Serbia's national flag on fire.
The indictment says that Luzha had offered the lighter to the suspect N.N., in order to set the Serbian flag on fire and, together with another unidentified person so far, had been held up until it was completely burned.
Therefore, for these actions, Luzha was accused publicly of promoting hatred among ethnic groups living in the Republic of Kosovo.
With this, it is accused of committing criminal work “The acceleration of division and failure to be” by Article 141, paragraph 3 concerning paragraph 1 and Article 31 of the Republic of Kosovo's Criminal Code.
