At the time when Kosovo was facing the damage scans of the attack on the Iber Lepenci channel and internationals described as a terrorist act and asked those responsible to respond to justice, a warning came from Belgrade concerning the Banjska case.
Belgrade's Chief Prosecutor of Public Prosecutor, Nenad Stefanovic, said that at the end of this year or early 2025 the decision regarding the establishment or not of an indictment against Milan Radojici will be made.
In Pristina these two developments are viewed as interconnected and at the order of Vucic, who may have been under international pressure for terrorist attacks in Kosovo.
Vucic's “Trics or tactics are already known, so when there is pressure from the European Union or from the QUINT states, he has immediately synced and Belgrade Prosecutor's actions that they are committing an indictment by avoiding international obligations”, lawyer Jevdet Smakqi said.
Jurists have no confidence that justice in Serbia will try to shed light on Banjska's attack and hold Radocic responsible.
Because in my conviction behind this [ Banjsca] attack, but also this last [Iber Lepenc], be it direct, or indirect, are the institutions and Vucic's machinery, I do not expect any real epilogue in handling this” event, said lawyer Ardian Bajraktari.
Although Serbia claims it has the right to judge this case after Kosovo considers it part of it, the fact is that it cannot help it because the event has taken place on the territory of the Republic of Kosovo.
Even considering the principle of territoriality, the place where criminal acts were committed on the part of Milan Radoicic has no painful or territorial competence for Serbia's prosecution to investigate, to accuse Milan Radoicic in light of the principle of unilaterality and non-respect for an objektive and independent trial”, said attorney Gjevdet Smakqi.
The extradition of Radoicic and his group in Kosovo to face justice is Pristina's continued demand, since there is even an act filed against him.
But this can only be done with international pressure.
In my belief only the continued and growing poresieon of the international factor, including EU countries and the United States of America, could result in changing the situation”, said lawyer Ardian Bayraktari.
