Izedin Bytyqi continues house arrest for another month, and Naser Hafizi's detention for two months

Bytyqi suspected of “Use of official task” and “Permission without permission”, whereas Hafizi for “Use of official task”, “Clearing money” and “Disreport or false reporting of income wealth, gifts, other property benefits or financial obligations”.

News of continuing measures against the two suspects has confirmed the “Justice Trust“, Mirlinda Gashi, spokesperson for the Foundation Court in Pristina.

Gashi said that for Hafizi, the detention measure has been continued from November 10th 2024 and will last until January 10th 2025.

The Special Department has approved the request of the Special Prosecutor of the Republic of Kosovo for continuing the measure of house arrest in criminal case against indictees I.B. According to the Prosecutor's file provided “Law on Justice”, Bytyqi is suspected of misusing his official duty and deliberately overstepping his competencies, acting contrary to the Law on the waters of Kosovo, as well as guidelines for water payment structure, bypassing the overall report of the ministerial group, which was formed in order to calculate the debt for ambalmers to ARPL, under which the general debt value report created by these economic operators is 19,729,47 euros.

It says the suspect, without legal grounds, as well as vetting the facts, has issued illegal decisions to reduce the debt of several economic operators with the aim of illegal profiting for itself or other persons, causing damage to the state budget.

And for Hafizin, initially the Constitutional Court in Pristina through the decision of October 11th 2024 was assigned to the extent of the 30-day detention period, Naser Hafizi, under suspicion of “Using official duty or authority”, “Clearing money” and “Ab reporting or false reporting of income wealth, gifts, other property benefits or financial obligations”. The Court of Appeals, on the other hand, had found that the defendant's defense complaint is unfounded and decided to leave Hafizin in custody.

By contrast, according to the Special Prosecutor of the Republic of Kosovo, the debt the economic operators had to account for the Regional Banking Authority (ARPL) was close to 20m euros. However, Naser Hafizi is suspected to have initiated a decision to reduce debts.

On the other hand, there is reportedly suspicion based that defendant Naser Hafizi, knowing that his wealth stems from illegal activity and is acquired with the intent of committing criminal acts, with the aim of hiding the real resource of wealth, cash-money has been introduced into the banking system in order for this illegal money to appear legal.

On the other hand, Hafizi reportedly in the quality of the top public official has been obliged to make the declaration of property, but had not presented the required data correctly. Naser Hafizi, who holds the position of task manager of the Regional River Lakes Authority at the Ministry of Environment, Spatial Planning and Infrastructure, was arrested on October 10th 2024 under suspicion of “Keq use of office of official authority”, “Clearing money” and “Ab reporting or false reporting of income wealth, gifts, other property benefits or financial obligations”.

The Special Prosecutor, during the action on October 8th, had indicated that Hafizi was not found in his residence.
