Haradinaj and Limaj expected to be heard as witnesses in judging Begaj and others for corruption

Joining them are Bashkim Krasniqi, director of Geodesia in the Malisheva municipality, Mala Krasniqi, the chief of Geodesia in the Malisheva municipality, Nazim Caffejolli, Kosovo Forest Agency inspector and Ahmet Canthmanaj, who is being charged with money laundering, reports “Betim for Justice”.
The defender of the accused Hasani, lawyer Huruglica, made such a proposal with the reasoning that by the time Prime Minister Haradinaj was prime minister, the decision has been made for the cadastral areas of Bellanica, Senik and Baj to declare areas of particular interest in establishing the economic zone.

According to him, these witnesses will explain what had been the reason for these three cadastral areas to declare areas of particular interest, as the accused Hasani at the time he was the minister of commerce has done only draftisation in Government.

This proposal was rejected by State Prosecutor Naim Abazi, with the reasoning that there is no support to this issue since they have been part of the government and possess the processes of what they have stated.

The proposal was approved by the chairman of the court, Judge Vesel Ismaili.

Similarly, during this hearing in witness quality, Haziri Hoxha was heard.

During his statement, witness Hoxha has said it was not right to create “economic zone” in the village of Bellanica, Banja and Senik after being denied their claim to return property inherited from their ancestors, which he said are their property.

According to him, these properties were obtained from the AKM in December 1958 on behalf of agrarian reform and colonisation.

As for these properties, witness Hoxha said they have addressed all state institutions and chief state prosecutor at the time Alexander Lumez but have not been answered.

“I believe here is a triangle between the Court, Komunas and former Agriculture Company Mirusha, on this triangle is AKP”, Hoxha said.

Witness Hoxha has now said he is convinced that witnesses who have been heard in this hearing have not told the truth, since one of them has said that the Malisheva Community in its possession has only 30 hectares, and in reality the same is owned by 45 hectares and found near Agricultural Airport. Hoxha's statement was made based on what former Mayor Isni Kila had told him

On the other hand, witness Hoxha has been asked by Judge Ismaili how many years they have courses in court for property returns, with the same cases saying that, from 2005-2006, property returns were in the former Malisheva Municipal Court, and that by 2007 no decision was made, only one owner was recognised this year, but the second scale had canceled.

In this regard, witness Hoxha has said that the Malisheva Municipal Court had no right to accept the permission course to consider since the same, according to him, had to declare itself uncompetent after 2002 the Special Chamber was formed under the Supreme Court on such issues alone.

The former communist court had to declare itself incompetent on the issue, as by 2002 the Special Chamber was formed under the Supreme Court alone on this issue, Hoxha said.

The same has added that in 2003 the initiative was made by the Malisheva Municipal Assembly to pass a regulation to restore property to residents, but they had received no response.

On the other hand, witness Hoxha said that, in 2004 The municipality has leased property to those who have wanted to receive, among them has been his father, while in a document issued by the Municipal Geodese Office in Malisheva former head of the municipal office for geodesy and cadastre Nuhi Shala is said to be “of social property in the use of private property”.

According to witness Hoxha, the document above has been lost somewhere by the APK.

Regarding this witness Hoxha has stated that, now the property- parcel officially figures in the name of the AKP, while earlier it was on behalf of his father.

Witness Hoxha said that, they find themselves damaged by prosecutor Abbas' co-operation with the injured AKP, with the reasoning that with the latter there have been agreements to inform him of everything about property.

The same was later asked by prosecutor Abazi, whether he could clarify why he thought the Prosecution co-operated with the AKP.

In this regard, witness Hoxha has said he bases it on what AKP representative Arben Hasi has stated at the February 21st 2022 session, where, among other things, Hasi had said he would co-operate with the Prosecutor until the end of this trial process.

Witness Hoxha added that the majority of these accused in the hall were just to make the matter volume because they are not to blame.

At the end of his statement. Hoxha, said, called on the prosecution to withdraw this indictment as unequivocal in fact and evidence, begging the court to dismiss this indictment because it is irregular and take action in their favour.

While, he has sought to bring down this indictment, for according to him, it is a previous crime that has been alleged.

Regarding the witness's statement Hoxha, the defendant's defence lawyer Begaj said it is fully compatible with the witness's statement Hoxha that the indictment is unfounded.

The next session was scheduled for July 25, 2023, at 13:15.

By contrast, the Special Prosecutor of the Republic of Kosovo (PSRK) on July 1st 2021 has filed charges against indictees Ragip Begaj, Hajdin Berisha, Berisha Union Krasniqi, Malë Krasniqi, Bajram Hasani, Faton Thaqi, Nazmi Caffejolli and Ahmet Candaniaj.

According to the indictment, Ragip Begaj, Hajdin Berisha, Bashkim Krasniqi, Malë Krasniqi, Bajram Hasani, Nazmi Caffegilli and Faton Thaqi are charged with having committed the criminal work of “Kest misuse of official position or authority”.

Ahmet Canthmanaj, charged with criminal work “Money laundering”, while Nazim Caffejoll is also charged with criminal activity “Deception”.

According to the indictment, Begaj is charged with exploiting the quality of the Malisheva municipality chairman, in co-ordination with then Minister of Trade and Industry Bajram Hasani and the deputy minister of this ministry, Faton Thaqi, using their official position with the aim of illegally benefiting rich benefits, have enabled expropriation in the cadastrale Banja, Bellanica and Senik areas of particular interest.

According to the indictment act, the Krasniqi Union in the quality of the director for Geodeze and Kadasser, Male Krasniqi in the quality of Geodesia services chief Hajdin Berisha in the quality of the municipality's deputy chairman and Faton Thaqi in the quality of deputy minister, are charged that, in co-ordination from May 22nd to June 5, 2018, depending on the positions, they have exploited the official authority, overcoming their competencies have enabled the area of special economic interest with the purpose of establishing the Economic Zone in the municipality in Malistraa, there are Baydà, and the procedures that continue with the procedures.

The charge in the indictment reportedly accused Male Xansanqi, having known about the creation of the Economic Zone, had acquired property in the Bunja and Ladrovc cadastral areas at a price of 25 euros per gold, knowing that these properties would be expropriated by the Government of Kosovo, where the price would be much higher.

According to the indictment of accused Nazmi Cafjolli, he is charged with renting the property of the late M.H. where he raised orchards for what he had obtained grants from the Ministry of Agriculture.

In addition, according to the accusation act, Ahmet Canthmanaj from 2007 to 2013 in a continuation of knowing that social-owned land parcels have been bought and created with criminal activities, transferred and at the same time attempted to transfer property for the purpose of hiding or hiding nature and avoiding legal consequences.

The accuser reportedly privatised the properties of “Newco Mirusha” agricultural land in the Basja cadastral areas, Bellanica and Senik in the Malisheva municipality at an artificially low price of 1,22,333.00 euros surface of 1,157 hectares of gold for 99 years, for this the accused on 11 July 2013 has been carrying land on behalf of the now-born MH person.
