Peter Shala has left the Special Court, where the case is taking place. Shala's lawyer, Jean-Louis Gilissen, has said the accused is feeling anxious and needs to calm down.
Shala is expected to be able to pursue the judicial process through video connection.
Mr. Shala gives up this trial, he doesn't want to stay here, so he gives up his right, he asks us to represent him and he wants to return to custody, because he needs to calm down, he needs to calm down”, the lawyer said.
The defence has said that, given Shala's situation, he has estimated that developments in the session should be followed by the detention centre.
He's a little nervous, doesn't appreciate how developments are going, and he prefers to watch the session in video connection, it's better for him. We met him twice before we started now, he was very nervous, very anxious, he was shaking, we believe it's better for him, and for everyone, to get back, so I would ask you to consider the request to return to the detention and ask permission to attend the video-connection session”, the Protection of Shala has said, broadcast the KP.
In this regard, there has been no objections from the prosecution that Shala is not physically present in the courtroom, but have demanded that the same follow sessions in another form.
While the court has issued oral orders that have approved Shala's request not to participate physically in the courtroom in regard to today's hearing.
The chairman of the court, Mapie Veldt Foglia, has asked the Administrative Office to organise the video connection as well as a direct communications channel between Shala and his lawyer.
The court has the authority to order Mr. Shala to participate physically in each session, every time the court estimates that his physical presence is necessary or when predicted by the regulation. As a result, we approve Mr. Shala's request to participate in the court process today, to participate in the detention centre”, the head of the court said.
The head of the court's shame has asked the defense to announce before every hearing, in case Shala does not want to be physically in the courtroom.
The hearing at The Hague is continuing with the second testimony in this court process, which is witness number 6.
Peter Shala has been held at the detention centre in The Hague since March 2021.
