Minister Haxhiu unlawfully annulled appointment of 162 swimming candidates

They had been candidates for the process opened by the Ministry of Justice in April 2019, where after a legal and fair process, the Professional Commission for NWA exam for Notera on July 12th 2019 had announced the final list for candidates who have passed the Notera exam, reports Blic newspaper.

However, Justice Minister Albulen Haxhiu had cancelled this illegal process, with the decision No.15/2020, no.01-173, dated 24,02.2020. Over 100 indictments had been exercised for the annulment of this ruling, at the Constitutional Court, where the Justice Ministry's Department's Department for Administrative Affairs, with A.N.529/2020, on February 01st, 2022, annulled the Justice Ministry's decision No.15/2020, No.P.01-173, on the date 24.02.2020, while confirming the process of testing a legal and fair grade.

This act has reversed the previous situation and obliges the justice ministry to continue the remaining process, the appointment of candidates who had run, respectively, and are potential candidates for appointment for notary, based on the commission's final list of selecting notaries.

And, after that decision, over 100 complaints of appointment were filed in the Ministry of Justice, but they faced opposition from it.

That being so, they have submitted their requests but have again encountered a non-legal response from MD.

Because of this situation that candidates are found in front of the Ministry of Justice, which did not enforce the Court's ruling, they filed lawsuits at the Pristina-The Department of Administrative Affairs, where they have asked the court to order the indicted Ministry of Justice of the Republic of Kosovo, which in the run of thirty days, from the day of acceptance of the court to issue the administrative act of the Noter's appointment, on the territory of relevant municipalities, according to the announcement of the public competition for the November 23rd19 elections, and with the proposals of candidates who meet the legal conditions.

Following the Court's verdict, which annuls the justice minister's decision, Albulen Hadziu, as illegal, and confirms the exam process as legitimate and fair, the Ministry of Justice instead of acting in accordance with the court's final and final convictions, with the date 01.11.2023, has published the public declaration of the Noteria exam, where the deadline for application is November 02th through November 22nd to 2023 despite the fact that it is known to the process of candidates which is still active and the execution of the prosecution and the request of the justice court has again filed a public application.

Therefore, the public announcement of the exam for the swim date 01.11.2023 of the Ministry of Justice seriously violates the interests of 162 certified swimmers who, in 2019, face the consequences of the injustices caused by the MD against these candidates.

So, the Ministry of Justice has an open competition in which the competition is 162 candidates certified for swimmers who are awaiting the realization of their already won right with court ruling.

162 candidates demand that the ministry be known why they are denied their right, until and the Court has given them the right and that decision is not being implemented.

On this issue and what is expected to happen with 162 swimming candidates, the newspaper Blic has sent questions to the Ministry of Justice, but by the time it is published, no response has been given.
