Isufaj: Banjska is being treated with seriousness, Haxhi Kurt's statements in Prosecution affairs

Blerim Isufaj continues to be one of the most vocal exhibitors of public life, not only because of the post he holds, but also because of reports with politics, President Vjosa Osmani and Prime Minister Albin Kurti. The first has not decreed for the chief state prosecutor when his name went to his office, while Prime Minister Kurti has publicly said that Isufaj will become chief prosecutor.
From these positions, Isufaj's Kurt also marked a weekend crash after Special Prosecutor indicated Friday at a news conference that he had consented at a phase that Milan Radojciqi was removed from arrest warrant, as suspected of the murder of Oliver Ivanovic politician in the northern part of Kosovo in 2018.
This statement and the September 24th terrorist attack on Banjska, which is being handled by the Special Prosecution, has deepened the clashes between Kurti and the Chief Prosecutor of the Special Prosecutor. Kurt wants to act quickly on this case, until he has publicly expressed doubts about what the prosecution is doing.
I'm here to help, but they're there to work. I can't help someone who doesn't. I can only help someone who works”, has declared Prime Minister Albin Kurti a week ago when he and Interior Minister Jelal Svechla went to the conference and published the names and photos of identified persons as involved in the attack.
Special Prosecutor's Chief Prosecutor, Blerim Isufaj, has said he does not handle these statements until he reminds Kurt that they are independent institutions.
For investigations concerning the September 24th attack, Isufaj says the case is being addressed with the right seriousness.
The first Special Prosecutor declares they are awaiting the outcome of the investigations to decide regarding the performance of the case. Other information says they can be separated, since the case is under investigation.
“Special Procurory as an independent institution for investigating and prosecuting perpetrators and prior criminal acts with the Criminal Code and the Special Prosecutor's Law exercise the prosecutorial function independently and conforming legal provisions to force. Regarding your questions about the case regarding the September 24th terrorist attack on the Kosovo Police, I inform you that it is being dealt with with with with the right seriousness and the moment the investigations are completed, we decide on the further progress of the case, because at this stage of investigation, we cannot share any information about the case with the public, including the answers to the questions posed (4)x1>, Isufaj declares.
The chief prosecutor this year was constantly on Kurti's focus.
At a Kosovo Assembly session in April of this year, Kurti had said Isufaj is opposed to his government. The statement was made after the Special Prosecutor had ordered the arrest of Kosovo Energy Corporation chief Nagip Krasniqi, close to LVV.
Prosecutors who commit suicide and suicide commit murder despite the will and position of the president, prime minister and prime minister, want to, at any cost, whatever circumstances, certainly become chief prosecutor. But they won't. They won't. Not because it's me. Not because you are. But because there are both Republics and people” in this country, Kurti expressed himself.
As a opponent of Kurti Government, Isufaj was also labeled by Justice Minister Albulen Haxhiu. Referring to Isufaj's candidacy, Haxhiu had said that “Kosovo does not need a chief prosecutor who has the tail occupied by the door” and that he has no will to fight big fish. ”
Haxhi's statements, Isufaj, have described them as a tendency to intervene in the work of the prosecutorial system.
With your question about the statements cited by state leaders, we declare that as an institution we do not comment anyone's statement, respect and obey only the decisions of the Kosovo Prosecutor's Council. I add only that I am sorry that such statements come from a Kosovo Justice Minister, even I appreciate such statements as a tendency to intervene in the work of the Kosovo Prosecutorial System”, Isufaj has declared for Gazette Express.
For statements by Prime Minister Albin Kurti, Isufaj has also responded at the annual conference, where he said it is not the job of prime minister to establish charges.
“... It's not his question to file an indictment, it's since the justice system. We act out when we conduct the investigation and no one can tell us when we have to file charges”, Isufaj said yesterday at the annual conference.
A few hours later Kurt retorted that statement. He said it is surprising that even though Milan Radojcik has accepted organisation and participation in the terrorist attack in Bansjka, there is still no indictment.
I don't know if you share my surprise. How come Milan Radojcic admits he committed the crime and there is no indictment. I believe that neither should I go to law school nor need Bachelor, Master or Phd, nor should there be any need for prosecutor or judge, but only the normal reason of the citizens of the Republic identifies such absurdity”, Kurti said.
Chief Prosecutor Isufaj had also ruled for the position of chief state prosecutor, the position for which he was elected by the Kosovo Prosecutorial Council.
However, Kosovo President Vjosa Osmani has refused to decree it, saying there have been violations in the selection process.
Osmani had said that on the case of the chief prosecutor he has faced illegal pressures.
There were people who sent messages that if you don't decree, we're going to file, we're going to file, we're going to set up an indictment”, said Osmani, calling it “disturbing” the idea that people inside the system could threaten the country's president on a case.
The majority of violations, which are part of the presidency's assessment, have also been listed along the procedure and made public by civil society monitoring organisations as well as by US embassies Germany and the EU Office”, the president had declared.
But KKPCH has sent back the name of Blerim Isufaj for decree.
The United States and the European Union, in particular Germany, had considered it surprising, disappointing and disturbing, the way the Prosecutorial Council had chosen Blerim Isufaj for State Chief Prosecutor on April 6, 2022. The Kosovo Prosecutorial Council had unanimously voted Blerim Isufajn to succeed Aleksandar Lumez in the position of chief state prosecutor. When Lumez's seven-year term ended, KKP had appointed Besim Kelmendi as the acting prosecutor of state.
Disgusted with the situation in the prosecutorial system, the government had compiled a new law on the Kosovo Prosecutorial Council, which in June last year was adopted in the Assembly. This law envisioned changing the composition of the KKP, but was later declared invalid by the Constitutional Court.
The Constitution had rejected the law, which according to the Government would pave the way for deep reforms in the justice system.
The overturned law determined that six of the nine current prosecutors in the KKP would be suspended. Three, who would remain there by the end of the mandate, would be selected by a lot, as Minister Albulen Haxhiu said. To complete the composition of the KKP, elections would be organised at the level of all prosecutors, where each prosecutor can vote.
The highest instance of legislative and executive power in Kosovo has had serious remarks, especially at this point. According to the Constitutional Court, this would also have implications for democratic order and rule of law in the country.
