The Commercial Court has ruled against the two businesses' proposal to postpone the Ministry of Industry, Trade and Trade decision (MINT) to abolish business certificates.
The decisions in Business Club L.L.C. and Vitalan L.L.C., whose certificates were abolished at MINT's decision, have been reviewed by the Court of Commercial Court judge Vlora Pacolli-Rejep, sister of the Vetvendosje Movement MP Victory Pacolli.
MP Pacolli's sister, in the two submitted commitments, is listed in line with the decisions of Minister Roseta Hajdari. He has decided against the proposal of two Business Club L.L.C. and Vitaland L.L.C. businesses. for setting up security measures.
In August of this year, the Ministry of Industry, Intervention and Trade had abolished licenses around 50 businesses because their “long registration has handed out documents with restraint contrary to constitutional principles and the law in force”.
Under the Comercial Court ruling, the execution of these decisions will not be postponed until the court decides with the final judicial decision.

In reasoning with the Comercial Court's First Chamber decision, Judge Pacolli-Rexepi praised the prosecution's proposal would cause “irreparable damage to indictee”, which in this case is the Ministry of Commerce, led by Roseta Hajdari.
“The court praised the plaintiff's claim that postponing the controversial decision would not bring any harm to the opposing side because the contentious issue between the parties has nothing to do with monetary values, assessing it as unmanaged, and reminds that the damage is not only about monetary values, but has to do with the damage to authority and reputations that would be due to the postponement of the verdict filed against”, the verdict of Judge Vlora Pako-Reja, issued on September 19th.

In contrast to two cases of Business Club L.L.C. and Vitaland L.L.C., in the cases of Kosovo and three others, the judge who examined the subject was not related to any ruling party officials.
Judge Arnis Duman, who ruled against the closure of Kosovo's Clan, in his decision had estimated that postponing the execution of the decision in favour of Kosovo would not cause harm to the Ministry of Commerce.
The decision in favour of Kosovo was confirmed by the Second Stair Chambers at the Commercial Court.
In a decision issued on September 18th, the Second Stair Rooms have found the Ministry of Industry, Trade and Trade complaint to Kosovolan and have proven the court's decision in the first instance.
