Democratic League of Kosovo MP Driton Selmanaj has said President Vjosa Osmani's conference on the case of the chief prosecutor is scandalous.
Selmanaj has said Osmani has testified yesterday that for 18 months he has abstained in the exercise of tasks that the Constitution of Kosovo defines.
He's further said Osman's reasoning that he's ordering Isufaj because of scremated violations. Selmanaj says Osmani has expected that any of the instances of regular courts are giving him a single reason to then implement Kurti's request for Isufaj's failure.
LDK MP has also written about President Osmani's claim to have been threatened. Selmanaj has said Osmani has either lied about this or has confidence in the country's institutions, which itself stands in the highest institutional hierarchy.
Full response:
President Osmani's SNANDALOZ education.
Scandal No. 1
She yesterday testifies that for 18 months she has abstained, in exercising obligations that the constitution of Kosovo has set.
Article 84.2 The Constitution when it comes to the president's competencies says:
S
“ganizes constitutional functioning of defined institutions
Constitution”
This paragraph attributes the republic's president with the competence of ensuring the constitutional functioning of constitutional institutions defined by the constitution. So this rate is not facultative or desired for the president, so it is not left to its will, but it is the necessary binding constitutional rate, to act for the better constitutional functioning of constitutional institutions.
So the country's president, the Republic of Kosovo, has left it more than 18 months without its chief prosecutor. The independent institution, which has authority and responsibility for prosecuting persons charged with any criminal offence, has left it for a year and a half without a leader.
Scandal number two.
The president's decision not to appoint the candidate proposed by the Kosovo Prosecutorial Council conflicts with Article 84 prefix 17 of the Kosovo Constitution.
According to this article, the presidential competency for “the name” and “setting” is limited to ceremonially. The president of the Republic cannot control the credit for “proposal” coming from the Prosecutorial Council, so the president cannot exercise substantiial control over the Council's proposals. The only room the president has at his disposal is the control of the procedure regulation followed by the KKP.
The fundamental problem posed in the concrete case is that, did the president really take 18 months to understand the economic procedural violations of the process developed by the KKP? Or he expected any of the incidents in the regular courts or Constitutional Court would give him a single reason to then implement Albin Kurti's request for failing to appoint a candidate proposed by the KKP.
Its reasons that she has waited so long to understand what was going on with the complaints of candidates in the instances of fair courts and the Constitutional Court do not stand at all, because issues that were addressed in these institutions had to do with the terms of complaints, but not with violations or irregularities in the process.
Scandal number three.
The president, among other things, claims that the prosecutor's case has faced illegal pressures. There have been people who sent messages that if you don't decree it, we'll file, we'll set up charges”.
In the question of why you haven't denounced such pressures in competent bodies, she answers:
This should be procedure, in case a justice system functions. That's like saying go deposit it to those who threatened you”.
All this part is terrible in its entirety.
The first of the country, I publicly show that it is hiding or silent for the criminal work in which it is subject.
And if that really happened, but the president doesn't condemn them to competent organs, then that's either her big lie or she doesn't trust anything in state institutions that stand in the highest institutional hieracy in our republic.
