Since this is not the case, international arrest should be issued through the United Nations Mission in Kosovo UNMIK.

Radocic was acquitted Wednesday of Serbia's Supreme Court, a day after being detained, under suspicions that he has committed a series of acts including arms trafficking and crimes against general security. He was also banned, going to Kosovo.

Last week, Kosovo authorities held him responsible for the September 24th attack on Kosovo police in the village of Banjska in Zvecan, where Sergeant Africa Bulnjaku was killed.

In the subsequent shootout, three other Serbian national attackers were also killed.

Radocic accepted responsibility through his lawyer in Belgrade.

Kosovo authorities said that behind him lies the Serbian state leadership, which targeted “anexing the north of Kosovo”, but Serbia denies it has a finger.

The first thing we want is for [the Serbian state] to hand over Radociqi and other terrorists to the Republic of Kosovo so that justice can be put in place”, Kosovo President Vjosa Osmani said., in an interview for television network CNN, October 3rd.

Procedures to Follow Kosovo

Ehat Miftaraj, from the Kosovo Institute for Justice (IKD), says the arrest for Radociqi would have to be initiated by the prosecution in Kosovo, approved by the court and forwarded to the justice ministry.

“From the Ministry of Justice of Kosovo would be sent to the UNMIK Interconnecting Office, which then puts it on Interpol database as RlCRNicè [red ID]”, Miftaraj explains Radio Free Europe.

Red identification alerts police worldwide for internationally sought fugitives and helps to bring them to justice, even after many years.

The red announcement is published by international police organisation Interpol, at the request of a member state.

Since Kosovo is not a member of this mechanism, it has been doing so through UNMIK since 2003.

Radio Free Europe Asked U n NMIK how it will act in the event it is applied by Kosovo authorities to speak of arrest against Radojici, but, until the publication of this text, there was no answer.

Miftaraj explains that, in parallel with the Interpol arrest speech, provisional arrest requirements are made pending extradition, which would be sent to Serbia.

The second request is initiated by the Kosovo prosecution, adopted by the court and sent to the Ministry of Justice, which is forwarded to Serbia's Ministry of Justice”, Miftaraj says.

For Serbia to hand over Radociqi to Kosovo, it would have to be subjected to any major pressure from the international community, Miftaraj adds, otherwise <x0-volts are small”, according to him.

“The IKD constantly asks the international community to pressure Serbia to ban practices that are contrary to the values of rule of law. So criminals commit crimes in Kosovo and find refuge in Serbia”, Miftaraj says.

Radio Free Europe asked the European Union Mission to Kosovo, EULEX, if it wants to mediate between the institutions of Kosovo and Serbia regarding the Radojic case, but did not receive answers.

This mission has in its mandate that “facilitates the exchange of information between the Kosovo Police and Interpol, Europol or Serbia's Ministry of Internal Affairs”.

The EU said only that Kosovo has a mandate to investigate the attack in Banjska and that Serbia is obliged to co-operate with it unconditionally.

The REL question whether it will co-operate with Kosovo institutions in this case did not answer even Serbia's Interior Ministry.

Speaking to CNN, Kosovo President Osmani said Serbia should hand over all “terrorists” who participated in the Banjska attack.

Serbia has no good record of putting justice in the country. There is no case when criminals who committed war crimes and genocide in Kosovo and Bosnia are brought to justice”, Osmani said.

Kosovo Interior Minister Xhelal Svecla said in an interview for Radio Free Europe on 29 September that there are “over 80 terrorists,” involved in the ongoing investigation into the Banjska attack.

The largest number allegedly went to Serbia.

Svecla said the responsible authorities would require the handover of Radojici and “of all those involved in planning and realising the terrorist action” in Banjska.

Kosovo Justice Minister Albulen Haxhiu told Radio Free Europe on 2 October that Serbia has so far rejected any co-operation with Kosovo and that international intervention will be necessary.

Agreement between the two countries

Kosovo and Serbia have an agreement for mutual judicial assistance, which was brokered by the European Union in 2013.

On the basis of that, the two countries can exchange judicial requirements through EU representatives. But legal co-operation is weak and, so far, there have been no extraditions.

Court monitors point to continued postponement of criminal procedures in Kosovo, due to, as they say, Serbia's lack of co-operation, especially when it comes to acts related to war crimes or cases involving high profile individuals.

Serbia is “before” for individuals performing criminal acts in Kosovo, because it refuses to co-operate about their prosecution, Miftaraj concludes.
