Former Ambassador Avni Kastrati, fired by president, wins the course at the Constitutional Court

The Constitutional Court has entitled former Kosovo Ambassador to Slovenia Avni Kastrati in his complaint against the court's first three-degree decision to reject the indictment against President Vjosa Osmani's decree for his dismissal.

In May 2021, Avni Kastrati was fired from the post of Kosovo Ambassador to Slovenia through a decree by President Vjosa Osmani.

Against the President's decree, Kasatrat had filed charges at the Constitutional Court in Pristina. The latter had rejected the indictment as illegal.

The Constitutional Court's decision was also confirmed by the Court of Appeals and the Supreme Court.

But the Constitutional Court, through a conviction announced Friday, has concluded that in the trial of the indictment exercised by former Ambassador Kastrati, three steps of courts have violated two provisions of the Constitution of the Republic of Kosovo.

“Gjykata, applying these principles under concrete circumstances, found that the President's controversial decree of release from the post of application for a pre-recognition, including “Civil rightsContact...” or “Conflict” in the sense of the right to fair and impartial judgment guaranteed by Article 31 of the Constitution and with Article 6 of the European Convention for Human Rights, and therefore, and even based on Constitutional provisions and applicable legislation, belongs to a set of individual character decrees that can be disputed in regular courts”, it is said in the Constitutional Act.

The court has found that the rejection of Avni Kastrat's indictment as illegal had rendered him unable to access “access to justice”.

On May 20, 2021, the Ministry of Foreign Affairs had dismissed 13 ambassadors, including Avni Kastrati.

Kastrati, before serving as ambassador to Slovenia, was chairman of the Mitrovica municipality.
