Svechla lacks trial against him and 12 others accused of violent actions in the 2013 protest

The announcement of his failure to attend the session, according to Judge Erol Gashi, has been made through a letter sent to the tribunal by the minister's cabinet, reports the Law on Justice.

Not present at this session were Arsim Maqastena, Pajtim Havolli, Egzon Azemi and Demaj, who, according to Judge Gashi, were the same guests through the June 6, 2022 report, but that lack of reasoning.

Regarding the absence of indictees Agron Kabashi and Akrem Hoxha, Judge Gashi said the court has issued an ordinance for forced behaviour, but from relevant police stations there is no excuse for failing to implement the ordinance.

In contrast, regarding the absence of indictees Dardan Molliqi, Frasher Krasniqi and Nol Nushi, Judge Gashi said the court has issued the ordinance for forced behaviour and that police have reportedly acted on the ordinance but that they have not been able to comply with relevant addresses.

So, under these circumstances, Judge Gashi stated that the court with a special verdict would set aside this criminal procedure as far as defendants Dardan Mollajqaj, Arsim Macesten, Pajtim Havolli, Egron Kabashi, Egzon Azemi, Pajtim Demaj, Xhelal Svechla, Frasher Krasniqi, Nol Niushi and Afrem Hoxha, who will create classes with a new number, while this case will continue with regard to defendants Bekim Shkodra, Samivd and Besnik.

Under these circumstances, after the indictment was read by prosecutor Bessart Mustafa, accused Shkodra, Avdiu and Celaj were declared concerning guilt.

The accused Shkodra pleaded guilty to criminal conduct participation in the mob that committed criminal acts and hooliganism, while he was acquitted of the criminal act of assaulting the official person during the official duty.

The accused Avdiu, however, did not feel guilty of the criminal offense, saying that he was not a participant in this crowd and that this is evidenced by pictures he is not present.

On the other hand, accused Celay pleaded guilty to criminal work participation in the mob that committed criminal acts and hooliganism.

With the pleas filed by accused Shkodra and Celaj agreed to both the prosecutor Mustafa and was approved by Judge Gashi, who said the procedure would again be isolated against them and the court's declaration will take place 2 August 2022.

Meanwhile, concerning accused Avdiu of criminally participating in the mob that committed criminal acts and hooliganism and accused Shkodra of criminal acts of assaulting the official person during the conduct of official office, Judge Gashi announced the parties for a 30-day term on the right to present the opposition to evidence and demand to cast the indictment.

Otherwise, even the scheduled sessions on August 10, 2021, and February 3, 2022, had failed to hold in the absence of some of the accused.

In the indictment, provided by “Justice Vowtim”, established in March 2014, results in charges of this criminal act along with Minister Svecla are Dardan Molyqaj, Arsim Maqastena, Pacim Havoli, Agron Kabashi, Egzon Azazi, Pajtim Demaj, Frasher Krasniqi, Noushi, Bekim Shkodra, Andrim Hoxha, Sami Avdiu and Besniki.

They are charged that in the protest, organised on June 27, 2013, against ratification of the agreement on normalisation of relations between Kosovo and Serbia, they have thrown stones, color, glass spheres, bottles and pyrotechnics against some police officials, with four police officers being injured and four official vehicles damaged as a result.

Indictee Bekim Shkodra is also being charged with the criminal act of assaulting the official person during the official duty.

According to the indictment set up on March 14, 2014, by Pristina Constitutional Prosecutor Dardan Moliqaj, Arsim Maqasten, Arsim Havoli, Agron Kabashi, Egzon Azemi, Pajtim Demaj, Jelal Svecla, Frasher Krasniqi, Nol Nushi, Bekim Shkodra, Afrem Hoxha, Sami Avdiu and Besnik Celaj are charged that on June 27, 2013, on the “nerez 11x1> street in Pristina, during the protest with the intent of damaging Kosovo police officials having committed violent actions.

All in accordance with this indictment, Svecla and the other accused are charged that during this protest, stones, color, glass spheres, bottles, pyrotechnics in the direction of members of the Kosovo Police, with the result of these actions, slight bodily injuries the police have suffered Rift Geci, Halil Syla, Agim Xheli and the Hyseni Union.

According to the prosecution, material damage has also been caused during the protest, where official uniforms and equipment of police officials were damaged during maintaining public order and safety, and have also damaged two cars, Kosovo Government property and two Kosovo Police owned cars, causing serious consequences.

With these actions, the prosecution charges the accused that each alone committed criminal work “The crowd's participation in criminal acts and hooliganism” by Article 412, paragraph 3 related to paragraph 4 of the Penal Code, which provides penalty for a fine fine of 200 to 10 thousand euros for hooliganism with minor consequences or prison of up to five years for hooliganism with serious consequences.

While the second device of this indictment, Bekim Shkodra is also tasked with the criminal act of “The attack on the official person during the performance of official duty” by Article 410, paragraph 2 of the Penal Code, which the chief is sentenced to imprisonment of six months to five years. /Betimy for Justice
