“On behalf of the signatory deputies we have prosecuted a request for legitimacy and laws for the Kosovo Prosecutorial Council and do not agree with the way it came. The amendments seem to contradict the Constitution. Interferences are unhealthy in democracy, but also for the independence of the judiciary, which is trying to secure democraticly and without interference and without what we call institutional seizures of this important institution”, Zemaj said.

The chairman of the PDK Parliamentary Group, Abelard Tahiri, has also handed over to the Constitutional Court the Law for the Kosovo Prosecutorial Council (KPK), which conflicts with six provisions of the Kosovo Constitution.
Tahiri has said there are many issues that make this bill incompatible with the Constitution on the one hand, and unacceptable because of the possibility it creates for political intervention on the other.
This law severely affects the independence of the Kosovo judiciary. It is a law that extends the influence of politics to the prosecutorial council. Since the establishment of the institutions of the Republic of Kosovo, we have never seen such a tendency to capture the Kosovo Procusioal Council. This law conflicts with six provisions of the Kosovo Constitution. The arguments he has brought The PDK, we consider it to be a possible basis to bring such a law against the Constitution.” has said Tahiri. Furthermore, he has said that the Government, through voting this law, has seized the justice system in hand through the Prosecutorial Council.
“Among the two readings, no Venice Commission recommendations have been taken into consideration either. Hence, these are additional reasons why this law conflicts with the Constitution. This law also degrades the political composition of this Council. Now, anyone can become a member of the Prosecutorial Council, as long as he has policy support. So now, the Prosecutorial Council is directly dependent on politics, respectively.
