A year and six months in prison for Mendjiq, charged with the police bid

The announcement of the indictment against him was made Tuesday at the Pristina Foundation Court by Judge Alltane Murseli.

The indictment is said to have taken place in the way that in the tender “Fourncing in elegant clothes” -- preceded in value of 730 thousand euros -- the commission during work in the composition of defendant Mendjiqi, Sabide Beqiri and Naim Lahu -- had conspired after the check that none of the economic operators, out of eight had competed, have met the pre-emptive conditions in the tender.

Always according to the indictment, then the defendant in order to enable economic operator “Artius Group KPS”, to win the tender even though he had failed to meet the terms, on August 8, 2017, until he was standing in an office with the key on the table and illegally, without the presence of the other members of the commission, and in time of pause goes to the Procuration Office he gets the package of “Artius Group<3>, replaces with elegant clothes and no other fixes, which he had brought out of the manual and back to the package.

The defendant reportedly had acted in this manner in order to have “Artius Group” illegally win the tender, worth 506 thousand and 216 euros and 20 cents.

With these actions, he is accused of committing criminal work “Using official position or authority”, by Article 422, paragraph 1 of the Penal Code, which is sentenced to imprisonment of 6 months to five years.

Otherwise, the defendant Mendjiqi, in his statement to the Prosecutor, has exploited his right and is quietly protected. While, in terms of the defense of the defendants, where the same has issued a statement at the Kosovo Police Inspectorate, the indictment is said to have been contradictory to itself and with statements given by other witnesses and unable to reason on his actions, respectively, the search for office residence during the pause, entry into the only procurement office, taking tender samples.

While the prosecution claims there is a well-founded doubt and possesses acceptable evidence that the criminal act was committed by the defendant, who bears responsibility for acting deliberately directly, considering that elements of criminal abuse of official office or authority have been manifested.
